This book investigates the framing of the terrorist threat in France from 2015 to 2020 as an ‘exceptional’ challenge which requires a ‘special’ public security response. The book examines how French political actors framed the terrorist threat in French political discourse from an exceptional challenge to a permanent, routine threat. It provides an in-depth critical discourse analysis of the French political narratives surrounding the activation of the ‘état d’urgence’ (state of emergency) following the 2015 Charlie Hebdo and Paris terrorist attacks, and traces this narrative until 2020. The study explores the securitisation-desecuritisation framework, showing how the normalisation of emergency powers reflects the ongoing (re)construction of terrorism within French political contexts. The work demonstrates the importance of threat framing and the securitisation of terrorism by considering the colonial legacies embedded in French counterterrorism (CT) policies. By investigating the intersection of CT political discourse, temporality, and colonial continuity, the book challenges traditional notions of exceptionalism in securitisation. It argues that the routinisation of counterterrorism measures highlights the impossibility of fully desecuritising terrorism (re-establishing the status quo), revealing how these measures are deeply rooted in France’s colonial past. The Northern Ireland peace process has been heralded by those involved as a successful example of transformation from a violent conflict to a peaceful society. The purpose of this book is to honour the influential and wide-ranging work of Professor Clive Walker. It explores Professor Walker's influence from three perspectives. This book opens up the discussion of the interrelation between terrorism studies, and peace and conflict studies. More importantly, policy approaches continue to inhibit, obstruct and reject frameworks that are concerned with the transformation and resolution of terrorist conflicts – partly because they see the state as the ultimate referent object to be secured. At the same time, peace and conflict studies seem to be excessively focused on problem-solving approaches, which overemphasise the role of parity during negotiations and misdiagnose the distribution of power both within conflicts as well as within conflict management, resolution and/or transformation approaches. Politicians and commentators have frequently made the argument that the rules of the game have changed, that this is a new kind of war, and that exceptional times require exceptional measures. In a regional, national and global response to terrorism, the emphasis necessarily lies on preventing the next terrorist act. Yet, with prevention comes prediction: the need to identify and detain those considered likely to engage in a terrorist act in the future. The detention of ‘suspected terrorists’ is intended, therefore, to thwart a potential terrorist act recognising that retrospective action is of no consequence given the severity of terrorist crime. Although preventative steps against those reasonably suspected to have an intention to commit a terrorist act is sound counter-terrorism policy, a law allowing arbitrary arrest and detention is not. A State must carefully enact anti-terrorism laws to ensure that preventative detention does not wrongly accuse and grossly slander an innocent person, nor allow a terrorist to evade detection. This book examines whether the preventative detention of suspected terrorists in State counter-terrorism policy is consistent with the prohibitions on arbitrary arrest and detention in international human rights law. This examination is based on the ‘principle of proportionality’; a principle underlying the prohibition on arbitrary arrest as universally protected in the Universal Declaration of Human Rights, and given effect to internationally in the International Covenant on Civil and Political Rights, and regionally in regional instruments including the European Convention on Human Rights. The book is written from a global counter-terrorism perspective, drawing particularly on examples of preventative detention from the UK, US and Australia, as well as jurisprudence from the ECHR.
