Establishing ethical and privacy protection aspects in scientific research, especially in medical research, has a long history. Medical data are usually more sensible than other personal data and require therefore an even higher degree of protection than other personal data. In recent research projects genetic evaluations become more and more important and trigger thereby new and continuing activities in the context of data protection. Genetic data as a subset of medical data are the most sensible category of personal data and require therefore the highest degree of data protection. The book provides a systematic and itemized approach to data protection in clinical research including the handling of genetic material, genetic samples as well as derived genetic data and the subsequent secure storage of them. The set up of different kinds of clinical trials having in addition a genetic part, the concept of a genetic informed consent as well as collection schemes of samples are described in detail. Technical requirements and aspects of data protection including pseudonymization and anonymization procedures taking into account ethics committees requirements as well as the underlying legal framework are also presented. Without any exception, all principles and methods presented are best practices, repeatedly applied in different clinical environments and by no means theoretical considerations.

Privacy protection, according to Colin Bennett and Charles Raab, involves politics and public policy as much as it does law and technology. Moreover, the protection of our personal information in a globalized, borderless world means that privacy-related policies are inextricably interdependent. In this updated paperback edition of The Governance of Privacy, Bennett and Raab analyze a broad range of privacy policy instruments available to contemporary advanced industrial states, from government regulations and transnational regimes to self-regulation and privacy-enhancing technologies. They consider two possible dynamics of privacy regulation—a "race to the bottom," with competitive deregulation by countries eager to attract global investment in information technology, versus "a race to the top," with the progressive establishment of global privacy standards. Bennett and Raab begin by discussing the goals of privacy protection, the liberal and individualist assumptions behind it, and the neglected relationship between privacy and social equity. This publication is the second volume of Thematic Human Rights Guides published under the auspices of the Raoul Wallenberg Institute of Human Rights and Humanitarian Law. The aim of the Guides, as the title implies, is to facilitate the use of international human rights standards by their systematic presentation. Rather than reproducing full texts of various instruments, substantive standards are grouped according to subject-matter in order to enable users to quickly and easily locate the topic they may be looking for. A detailed index, with references to the many international instruments which address the same issue, reinforces this thematic approach. The choice of human rights and health for the second volume in this series highlights the aim of the Guides: to map out the entire range of human rights and fundamental freedoms as they relate to a specific topic. The fight against the sexual exploitation of and trade in children has gained particular and renewed international attention in the last few years and has become one of the most important concerns in the context of international law enforcement policy and cooperation. Since 1998, policy makers have come up with new legal initiatives at global as well as regional levels in order to tackle this problem in a more effective and coordinated way. This proves that the time has come to match words and actions, and to come up with concrete and useful tools for law enforcement services and NGO's active in the areas concerned. The current study therefore examines the feasibility of the further elaboration and implementation of recommendations from a previous project (96/STOP/003) regarding the systematic gathering and administration of data concerning missing minors, minor victims of trafficking in or sexual exploitation of children and perpetrators of sexual offences against minors, with the goal to further prepare the practical setting up of several international databases with immediate relevance to the police and the prosecuting or investigating magistrates or officials, both in the EU Member States and the candidate countries. It is recommended to give Interpol a mandate to host an international database on missing persons and to create an EU monitoring centre responsible for the gathering and administration of reliable statistics and legal information on sexual exploitation of children and trafficking in human beings. It is also recommended for Interpol to host an international reference database on child pornography and to set up an analysis/intelligence child porn database at Europol. Regarding suspected and convicted sex offenders, it is proposed to create a database on pending investigations, an EU criminal records database and a database at Europol containing encoded information on both suspected and convicted offenders of sexual offences against children. Finally, it is suggested to create a European network of national DNA databases. The book also contains a summary of the conclusions in French.
