International regulatory relations have commonly been viewed through the prism of international organizations, on the one hand, and international trade disputes, on the other. However, neither of these perspectives offers an adequate understanding of the ways in which international regulatoryrelations are managed or may be managed more effectively. While the one risks overstating the readiness of states to cede regulatory authority to international institutions, the other risks ignoring the reality of and prospects for cooperative behavior.Transatlantic regulatory cooperation comprises a highly differentiated "bundle" of techniques for reconciling the needs of international trade with the diversity of national regulatory environments and public demands. The processes involved are still poorly understood, due partly to the fact thatthey have been very largely improvisational, with the result that the framework of regulatory cooperation is still very much a work in progress. Moreover, the main protagonists in this arena -- the US and EU -- have their own well-established domestic regulatory processes with which internationalinitiatives may not readily be integrated, either in terms of values or institutions. While focusing on illustrative sectoral examples of transatlantic regulatory cooperation, this book thus also explores the more general challenge of accommodating regulatory cooperation with domestic legal andpolitical institutions. The volume closes both by calling attention to inescapable legitimacy questions (e.g. reconciliation with principles of democracy and demands for public accountability) and by exploring certain strategic directions and institutional implications for the future.

Commercial ties between the United States and the 27-member European Union are substantial, growing, and mutually beneficial. However, differences in regulatory approaches limit an even more integrated marketplace from developing. To deal with this situation, a variety of government-to-government efforts have been created to dismantle existing regulatory barriers and to prevent new ones from emerging. These efforts fall under the rubric of transatlantic regulatory cooperation (TRC) and are at the heart of today's U.S.-EU economic relationship. This report is intended to serve as an introduction and primer on a complicated, broad, and often highly technical set of policy issues. Since the mid-1990s, both U.S. and European multinational companies have viewed divergent ways of regulating markets for both goods and services as the most serious barriers to transatlantic commerce. The primary reason why these companies seek to achieve greater harmonization in standards and regulatory procedures is to reduce costs imposed by complying with two different sets of regulations and standards.

Oliver Ziegler raises the question of what role economic interests of the United States play in the regulatory decision making process of the European Union. Critics often assume that U. S. dominance in the world economy, fueled by a powerful business elite, has significantly affected EU regulations at the expense of environmental and consumer protection standards. The author falsifies this proposition. He shows, first, that the EU often adopts regulations against the explicit opposition of the U. S. thereby ignoring the principles of transatlantic regulatory cooperation. Second, he demonstrates that business interests in the EU are usually not homogenous and often come second to environmental and consumer concerns. In addition, the author shows the increasing role of the European Parliament in EU regulatory decison making.

The European and American economies are closely interlinked as mutually important investment and trading partners. The growing intensity of economic interdependence has spurred the transatlantic coordination of rules and standards that can lead to the formation of non-tariff barriers to transatlantic commerce. But despite impressive government-to-government efforts to eliminate market barriers, the E.U. and the U.S. have frequently clashed over each other's regulatory policies. The aim of this book is to explore the domestic sources of cooperation or conflict in transatlantic regulation. The book analyses the role of domestic factors through three theoretical lenses that are well-established in the study of multilevel systems: the principal-agent approach, the two-level game metaphor, and through a wider concept of institutionalism which emphasises the links between societal interests and regulatory ideas with institutional frameworks. The book states that domestic factors embody more obstacles than opportunities for horizontal coordination. It is argued that transatlantic relations will likely undergo a ‘double movement’ of being simultaneously shifted upwards to become part of the global governance architecture, and downwards towards broader involvement of legislators in regulatory matters. Hence, transatlantic regulation might in the near future be shaped more by political leaders, rent-seeking interest groups and legislators than by networks of technocrats. This book was published as a special issue of the Review of International Political Economy.
