Increasing understanding of the role that secure water resources tenure plays in ensuring sustainable livelihoods, just resource governance, environmental protection, and sustainable economic development has led FAO to re-kindle the debate that had begun in 2012, when the Voluntary Guidelines on the Responsible Governance of Tenure of Land, Fisheries and Forests (VGGT) were adopted by FAO, and that had culminated in 2016 with the publication of the FAO seminal study “Exploring the concept of water tenure”. Picking up from where that FAO publication had left off, an Expert Roundtable on Water Tenure was convened by FAO in Rome, in December 2019, to begin the process of developing a common conceptualization of water tenure and its scope within the broader context of water resources and tenure governance. Strengthening the position of individuals and communities within the political economy of water resources governance, particularly for the rural poor whose livelihoods and food security depend on secure and equitable access to - water and land - was central to the debates. This report includes the Policy Brief and the Expert Roundtable Summary that explored the bundle of water-related rights approach to un-packing the concept and the practical ramifications of water tenure. This report is based on recent research and analysis that have helped to identify the core elements of water tenure based on data demonstrating how water tenure systems are legally recognized at the national level and how they function across diverse countries.

Satisfying the changing food habits and increased demand for food intensifies pressure on the world’s water, land and soil resources. However, agriculture bears great promise to alleviate these pressures and provide multiple opportunities to contribute to global goals. Sustainable agricultural practices lead to water saving, soil conservation, sustainable land management, conservation of natural resources, ecosystem and climate change benefits. Accomplishing this requires accurate information and a major change in how we manage these resources. It also requires complementing efforts from outside the natural resources management domain to maximize synergies and manage trade-offs. The objective of SOLAW 2021 is to build awareness of the status of land and water resources, highlighting the risks, and informing on related opportunities and challenges, also underlining the essential contribution of appropriate policies, institutions and investments. Recent assessments, projections and scenarios from the international community show the continued and increasing depletion of land and water resources, loss of biodiversity, associated degradation and pollution, and scarcity in the primary natural resources. SOLAW 2021 highlights the major risks and trends related to land and water and presents means of resolving competition among users and generating multiple benefits for people and the environment. The DPSIR framework was followed in order to identify the Drivers, Pressures, Status, Impact and Responses. SOLAW 2021 provides an update of the knowledge base and presents a suite of responses and actions to inform decision-makers in the public, private, and civil sectors for a transformation from degradation and vulnerability toward sustainability and resilience.

How could having farmers play experiential games contribute to improving groundwater governance? These games are an example of an innovative procedure, a policy instrument or institutional tool, which those involved in improving groundwater governance could use to understand their problems and opportunities; consider and possibly agree on norms or rules that might avoid aquifer depletion, and create shared gains that use water more productively. Institutional tools for groundwater governance could help deal with complex nexus linkages and achieve gains such as transitions to solar-powered pumping, aquifer recharge and storage to buffer against drought, and protecting and regenerating ecosystems. The concept of a groundwater governance toolbox offers a metaphor for thinking about the variety of policy instruments available and how they might be chosen, combined, and adapted to create customized toolkits to solve problems and achieve gains in specific contexts. New policies are typically layered on top of existing sets of institutions that govern relationships between people and water. This makes it crucial to understand existing knowledge and institutions and how those may interact with institutional changes. The thesis of the paper is that institutional tools need to be combined and crafted to fit contexts, including political economy constraints, opportunities, and solutions.
