Inhaltsangabe:Einleitung: Die Dissertation befaßt sich mit einem der praktisch wichtigsten Probleme, die sich nach einem Betriebsübergang für den Erwerber stellen: Der Frage, wie dieser Arbeitsbedingungen, die beim Veräußerer tarifvertraglich geregelt waren, verändern, insbesondere an die bei ihm geltenden angleichen kann. So bestehen beim Veräußerer oft tarifliche Regelungen, deren Aufrechterhaltung für den Betriebserwerber wirtschaftlich nicht tragbar ist. Einer Betriebsfortführung wird dieser deshalb nur zustimmen, wenn er eine Senkung von Lohn- und sonstigen Arbeitskosten herbeiführen kann, die Möglichkeit der „Flucht aus dem Veräußerertarifvertrag“ besteht. Auch eine abweichende betriebliche Situation beim Erwerber kann die Aufrechterhaltung zuvor vom Veräußerer noch geltender Arbeitsbedingungen hinsichtlich Arbeitszeit, Produktionsablauf usw. unzumutbar machen. Führt etwa die Übertragung eines Betriebs oder Betriebsteils auf einen neuen Rechtsträger dazu, daß der Betrieb(steil) unter den Geltungsbereich eines ganz anderen Verbandstarifvertrags fällt, ist die Möglichkeit der Angleichung der Arbeitsbedingungen an das nunmehr einschlägige Tarifvertragsrecht schon aus Wettbewerbsgründen unabdingbare Voraussetzung der Übernahmebereitschaft des Erwerbers. Wird der übernommene Betrieb bzw. Betriebsteil in einen bereits bestehenden Betrieb eingegliedert, kann der Betriebsfrieden nur dann gewahrt bleiben, wenn die Arbeitsbedingungen von übernommenen Arbeitnehmern und Stammbelegschaft nicht auf Dauer auseinanderfallen. The ever increasing relevance of European law which involves replacement or supplementation of and interaction with national law not only affects the states in Europe but also, and foremost, the citizens. The rights of the citizens in Europe are protected by the European Fundamental Rights and Freedoms. The aim of this textbook is to grasp and illustrate the meaning of these rights and to integrate it into a coherent system. For this purpose the book not only deals with the pertinent law of the European Union and the European Community, but also with the European Convention for the Protection of Human Rights and Fundamental Freedoms which, too, is becoming more and more important. In addition, regard is had to the Charter of Fundamental Rights of the Union which forms part of the Treaty establishing a Constitution for Europe. Although the Charter is not yet legally binding since the Constitution has not been ratified by all EU Member States, the Community Courts already make reference to it as a concentrate of the constitutional traditions common to the Member States. It therefore does not seem entirely unlikely that the Charter might be included into the existing Treaties irrespective of the future constitutional developments on the EU level. On a similar anticipatory basis the book also takes into account those Protocols to the European Convention for the Protection of Human Rights and Fundamental Freedoms that have not yet entered into force.

This book provides an overview on the major findings of a questionnaire survey of academic profession in international perspective. More than 25,000 professors and junior staff at universities and other institutions of higher education at almost 20 countries from all over the world provide information on their working situation, their views and activities. The study “The Changing Academic Profession” is the second major study of its kind, and changes of views and activities are presented through a comparison of the findings with those of the earlier study undertaken in the early 1990s. Major themes are the academics’ perception of their societal and institutional environments, the views on the major tasks of teaching, research and services, their professional preferences and actual activities, their career, their perceived influence and their overall job satisfaction. Emphasis is placed on the influence of recent changes in higher education: the internationalisation and globalisation, the increasing expectation to provide evidence of the relevance of academic work, and finally the growing power of management at higher education institutions.
