In den Pflichtenheften der Anwender besitzt eine Kompatibilität zu XML höchste Priorität. Und nahezu alle namhaften Softwarehersteller arbeiten mit Hochdruck daran eine XML-Unterstützung in ihre Produkte zu integrieren. Die schnelle Verbreitung führte jedoch auch zu einigen Missverständnissen, wie z. B. dem Glauben XML stelle einen Ersatz für HTML dar. Parallel dazu hat sich mit Content Management Systemen eine neue Klasse von Anwendungssoftware entwickelt. Nachdem diese zunächst vornehmlich zur Verwaltung von umfangreichen Websites Anwendung fanden, beginnen nun auch immer mehr Unternehmen die keine eigene Website betreiben ein solches System zu installieren. Beide Themen werden in dieser Arbeit behandelt. Dabei liegt der Schwerpunkt auf der Betrachtung von XML. Content Management Systeme, und im speziellen die Integration dieser in die weitere IT-Landschaft eines Unternehmens, dienen hierbei als Beispiel einer Anwendungsmöglichkeit von XML.

Inhaltsangabe:Einleitung: Mit dem Voranschreiten des Mediums Internet und der allgemeinen Vernetzung von Rechnern wird es immer wichtiger für alle Arten von digitalen Daten ein einheitliches, strukturiertes, standardisiertes, aber dennoch flexibles Format für deren Übertragung über Medien- und Plattformgrenzen hinweg bereitzustellen. Diese Aufgabe soll in Zukunft u.a. die Extensible Markup Language (XML) übernehemen. Ihr grundsätzlicher Aufbau sowie Anwendungsmöglichkeiten, insbesondere in Bezug auf die erste native XML-Datenbank Tamino der Software AG Darmstadt, sind Inhalt dieser Diplomarbeit. Bei den Grundlagen von XML werden u.a. ihre Abgrenzung zu SGML und HTML, der logische und physische Aufbau eines XML-Dokuments sowie XML-Parser und Namensräume näher erläutert. Weiterhin werden Referenzmöglichkeiten in XML-Dokumenten und Anfragesprachen für XML-Fragmente dargestellt. Für die Konvertierung von XML-Dokumenten wird auf die Stylesheet-Technologien CSS, XSL und XSLT eingegangen. Die Bedeutung von XML als Basis für ein Datenbank-Management-System (DBMS) wird ab Kapitel 5 erläutert. Hierbei steht die Untersuchung der ersten rein auf XML basierenden Datenbank Tamino der Software AG Darmstadt im Vordergrund sowie deren Unterschiede zu konventionellen Relationalen DBMS mit der Hervorhebung spezifischer Vor- und Nachteile. Zudem wird die Bewertung und Bedeutung von XML und Tamino für Unternehmensanwendungen praktisch anhand eines Content Management-Systems und eines Enterprise Application-Konzepts aufgeführt. Therefore, many legal subjects have to enter into the precontractual phase of negotiations that eventually lead to a conclusion or a failure of the treaty. As first outlined by Jhering in 18611, the precontractual phase can establish a legal relationship in which precontractual obligations have to be respected. In the following, the precontractual liability under the German, French and Portuguese law will be compared. After an analysis of the historical origin of the precontractual liability in general and the presentation of the historical developments in Germany, France and Portugal, the legal problem, that needs a regulation in the legal orders, will be defined. Furthermore, in the com-parison of the regulatory framework, the similarities and differences of the current legislations in the three states will be examined based on various criteria such as the legal basis, the concrete precontractual duties and the relevance of the good faith. Apart from comparing compensable damages, the legal institutes in those states will be classified. Before summing up the compar-ison of the roots and the legal institute by also including a grid of the main comparative aspects, important cases will be presented to understand the development of the precontractual liability in Germany, France and Portugal.

Linda Weiss attributes the U.S. capacity for transformative innovation to the strength of its national security state, a complex of agencies, programs, and hybrid arrangements that has developed around the institution of permanent defense preparedness and the pursuit of technological supremacy. In America Inc.? she examines how that complex emerged and how it has evolved in response to changing geopolitical threats and domestic political constraints, from the Cold War period to the post-9/11 era.
