Saggio critico sul volume di Massimo Brutti “Vittorio Scialoja, Emilio Betti. Due visioni del diritto civile”. Tale volume consta di due saggi, già apparsi a distanza di un anno nel “Bullettino dell’Istituto di Diritto Romano”: saggi dedicati separatamente a Vittorio Scialoja ed Emilio Betti, e dal taglio anche visibilmente diseguale, in quanto l’uno proponeva una ricostruzione d’insieme circa il metodo e il contributo scientifico del primo giurista, mentre l’altro si soffermava prevalentemente sulla posizione del secondo sia rispetto al Progetto di un codice delle obbligazioni e dei contratti comune a Italia e Francia, che nei lavori di redazione del nuovo codice civile (che avrebbe visto la luce nel 1942). Nonostante l’imperfetta simmetria dei due studi, la scelta di riunirli risulta senz’altro felice.

This volume examines the role of League of Nations committees, particularly the Advisory Committee of Jurists (ACJ) in shaping the statute of the Permanent Court of International Justice (PCIJ). This book traces the origins, life and death of Administrative Science in Italy as an academic discipline between the nineteenth and twentieth centuries. It does so by combining the study of ideas, institutional history, intellectual history and social history. The Faculty of Law first introduced Administrative Science in 1875, with the aim of providing the elite with the necessary tools to distribute wealth more equally, to take care of the population and, thus, to make the young Italian State more legitimate in the eyes of the emerging masses. Law and social sciences were merged with the aim of increasing reforms, including that of creating a State of Happiness for all citizens. Throughout its 70-year existence, Administrative Science was deprived of its contents and scientific independence, and academically overshadowed by Administrative and Public law. Finally, although the liberal elites discarded the reformer project of Administrative Science even before Fascism turned everything upside down, most of the original traits of this knowledge were absorbed into Fascist corporate and totalitarian structures.

This book examines the violation of property rights in the two World Wars and in the interwar period centering on three keywords: sequestration, confiscation and restitution. Political conflicts, regime change, revolutions and wars make not only people but also their property vulnerable. Plunder and confiscation were common ways of dealing with the enemy - either internal or external - in many conflicts, conquests and occupations during the Old Regime, and resurfaced as crucial political weapons in both the First and the Second World Wars, with disruptive effects. In the two World Wars and the interwar period, sequestration and confiscation grew in scale and scope, reaching an unprecedented magnitude because of three driving forces that were frequently intertwined: nationalism, socialism and antisemitism. Confiscation was a political weapon that furthered different aims. It helped to make the expulsion of enemy subjects irreversible. It was an instrument to exclude from the civic body those who did not belong - the 'internal enemies' - and to prevent undesirable people from acquiring citizenship. It also deprived “enemy aliens” of economic means during the conflict. Bringing together new historical research on Serbia, Italy, Belgium, Turkey, Holland, Poland, Czechoslovakia, Germany and Austria, the chapters address state violence, law and human rights, as well as the entanglement between citizenship, nationality and property. It will be of great interest to those who study minorities, borders, migration, social and economic history as well as European History.
