Democracy is one of the most used and misinterpreted terms of our time. In public discussions concerning the subject it is tacitly assumed that everyone is aware of the meaning of democracy and the implications it carries. In reality democratic ideals and practices take on various forms in various countries. Frank Hendriks sheds light on this subject matter in a comprehensible manner. He distinguishes four ground forms of democracy, which are inherent to democratic forms everywhere. Along with “consensus democracy”, Hendriks compares “pendulum democracy”, “voter democracy” and “participatory democracy”, at national as well as subnational levels of governance. Hendriks concludes in his studies that contrary to popular belief, not one model is superior to the others and calls for a realistic approach to a democracy that is sensitive to the context in which democracy must prove and sustain itself.

Deze thesis beoogt de beëindigingen van democratie in de Democratische Republiek van Congo (DR Congo) te verklaren. In dit onderzoek worden twee momenten uit de Congolese geschiedenis geanalyseerd die een illustratie zijn van democratie in (DR) Congo. Door middel van deze analyse worden de verschillende vormen waarop de beëindigingen van democratie in (DR) Congo tot stand zijn gekomen vergeleken. De eerste casus beschrijft de democratische ervaring van (DR) Congo na de verkiezingen en onafhankelijkheid in 1960 tot en met de beëindiging in november 1965 middels een militaire coup (coup détat). De tweede casus beschrijft de hernieuwde democratie na de verkiezingen in 2006 tot en met de beëindiging van deze democratie in december 2016 in de vorm van een constitutionele coup. De onderzoeksvraag in deze thesis richt zich op het verklaren van de factoren die een impact hebben gehad op deze twee vormen van beëindiging (en/of terminatie) van democratie in (DR) Congo. In het theoretisch kader worden verschillende redenen gegeven die de beëindiging van democratie mogelijk maakte namelijk: lage economische ontwikkeling, presidentieel falen, een zwakke burgermaatschappij en zwakke civiel-militaire relaties. Deze verschillende verklarende factoren werden getest i.c.m. een institutioneel sterke of zwakke president. De conclusie geeft weer dat alle bovenstaande factoren een invloed hebben uitgeoefend op de democratische beëindigingen van democratie in (DR) Congo in 1965 en 2016. Het verschil tussen de vormen van beëindiging kan toegeschreven worden aan de aanwezigheid van een institutioneel zwakke president in 1965 en een institutioneel sterke president in 2016. De militaire coup in november 1965 was deels mogelijk door een institutioneel zwakke president. Ook hebben de lage economische ontwikkeling, het presidentieel falen, een zwakke burgermaatschappij en zwakke civiel-militaire relaties bijgedragen aan de mogelijkheid tot het ontstaan van de militaire coup. Een nieuwe factor: externe bemoeienis/ participatie werd hiernaast ontdekt en toegevoegd aan de factoren die de militaire coup van 1965 verklaart. De constitutionele coup in december 2016 werd gedeeltelijk mogelijk door lage economische ontwikkeling, presidentieel falen, een zwakke burgermaatschappij en zwakke civiel-militaire relaties die gepaard ging met een institutioneel sterke president. Een nieuwe factor: vervuilde politieke cultuur werd hiernaast ontdekt en toegevoegd.

Since the mid-1990s more and more Argentines have been taking to the streets to express their dissatisfaction with the growing levels of poverty, social exclusion and violence. As part of this growing trend, the Movimiento del Dolor (a social movement consisting of the family members of victims of police violence) emerged as a protest against unaccountable law enforcement practices. As a result, police violence and impunity gained a place on the societal and political agenda, and several police reforms have been enacted. This book will offer a critical discussion of the interplay among the phenomena police violence, democracy and social movements. The present volume contains an in-depth analysis of the aims and impact of the Movimiento del Dolor. This study aims to contribute to a better understanding of the ways that social movements use citizenship as frame in order to address the fault lines of their democracies. As such, the book will show the dynamics inherent in a democratizing society that is characterized, on the one hand, by an active and mobilized civil society, generally fair elections and reduced military power and, on the other hand, the continuation of police violence, impunity, lack of political legitimacy and accountability, and the co-opting of social movements.

Democracy in the Courts examines lay participation in the administration of justice and how it reflects certain democratic principles.
