Inhaltsangabe:Problemstellung: Seit Ausbruch der Finanzmarktkrise im Jahr 2007 befinden sich die Finanzmärkte im Umbruch. Glaubte man anfangs noch, die Subprime-Kredite seien der einzige Grund für die Turbulenzen auf den globalen Finanzmärkten, so weiß man heute, dass weitaus mehr Faktoren dazu beitrugen, dass die Wirtschaft derzeit mit der wohl schwersten Rezession seit Anfang der 1930er Jahre zu kämpfen hat. Unkontrollierte Kreditschöpfungsprozesse sowie das Streben nach der höchsten Rendite haben schließlich dazu geführt, dass es zum Platzen der Kreditblase kam. Zwei Jahre nach der verpflichtenden Anwendung der neuen Baseler Eigenkapitalvereinbarung steht dieses Rahmenwerk heute in der Kritik. Wie konnte es trotz umfangreicher Eigenkapitalanforderungen und qualitativer Aufsichtsinstanzen zu dieser Finanzmarktkrise kommen? Haben die Baseler Eigenkapitalregeln versagt? Derzeit wird nach Lösungen gesucht, wie man das Gerüst für stabile Finanzmärkte verbessern kann. Ebenso wie sich die Finanzmärkte weltweit ausgerichtet haben, müssen sich entsprechend auch Aufsichts- und Regulierungsinstanzen neu orientieren - denn globale Märkte benötigen eine globale Aufsicht. Die vorliegende Arbeit stellt vor dem Hintergrund der aktuellen Finanzmarktkrise Lösungsansätze verschiedener nationaler wie internationaler Institutionen für eine Stabilisierung der Finanzmärkte vor und wertet diese aus. Mit den daraus gewonnen Erkenntnissen werden schließlich Vorschläge für eine Veränderung der Bankenaufsicht und regulierung präsentiert, um zukünftigen Krisen vorzubeugen. Gang der Untersuchung: Im zweiten Kapitel dieser Arbeit werden zunächst die Grundlagen staatlicher Regulierung erörtert. Dazu erfolgt in Kapitel 2.1 eine Abgrenzung des Regulierungsbegriffs. Kapitel 2.2 und 2.3 liefern anschließend die normativen sowie positiven Theorieansätze für staatliche Eingriffe. In Kapitel 2.4 werden darauf aufbauend theoretische Ansätze für den speziellen Fall der Bankenregulierung herausgearbeitet. Ausgehend von vertragstheoretischen Grundlagen wird zunächst eine Existenzberechtigung für Banken erarbeitet, um dann vor dem Hintergrund des Gläubiger- und Funktionenschutzes die Notwendigkeit für eine Bankenregulierung aufzuzeigen. Daraufhin folgt eine Darstellung bankbetrieblicher Risiken. Der letzte Punkt des zweiten Kapitels stellt schließlich die Aufsicht in Europa und deren Entwicklung im Rahmen von Basel I und Basel II im Hinblick auf quantitative sowie qualitative [...]
