This book examines the cases of implementation failure of the Indonesian Anticorruption Law 1971 of the authoritarian New Order regime, and of the Anticorruption Law 1999 of the democratic Reform Order regime. It investigates to what extent and for what reasons the implementation of these Laws failed to attain the policy objectives of eradicating corruption in the public sector under the two different political systems. The book concludes that combating corruption in a developing country undergoing political transition from an authoritarian to a democratic political system is problematic and difficult. When corruption has systematically infected and distorted the institutional structures and processes of the government, in particular the law enforcement mechanisms, implementing anticorruption laws is expected to be suboptimal and subsequently fail. To overcome this problem, the factors contributing to the policy implementation failure must be eliminated.

Activists in Transition examines the relationship between social movements and democratization in Indonesia. For Indonesian society, corruption remains a huge problem. Some of the reasons for this are easy to identify, flowing on from the authoritarianism of the Soeharto New Order (1966-1998). Other factors are less well known and less able to be easily intuited. As Todung Mulya Lubis, one of Indonesia's leading human rights lawyers and most influential legal thinkers, explains, 'Now corruptors come from the legislature, government, judiciary, and business communities, and they are not simply thieves but rent-seekers, benefiting from rapid economic development and weak law enforcement'. In Todung's telling, the best efforts of the most unswerving and talented Indonesian opponents of corruption have been frustrated since the epochal overturning of the Soeharto regime a generation ago. This story, however, is not without flashes of illumination. As Todung also shows, in recent decades there have been very many successful prosecutions of corrupt government and state officials, from the lowest levels to the very upper echelons of society. Why did Albania enjoy some of the most successful anti-corruption programs and institutions along with what appeared to be growing levels of corruption during the period 1998-2005? Looking at corruption through a post-structuralist discourse analysis perspective this book argues that the dominant corruption discourse in Albania served primarily to institute the neoliberal order rather than eliminate corruption. It did so in four interrelated ways. First, blaming every Albanian failure on corruption avoided a critical engagement with the existing neoliberal developmental model. Second, the dominant articulation of corruption as abuse of public office for private gain consigned it to the public sector, transforming neoliberal policies of privatisation and expanding markets into anticorruption measures. Third, international anticorruption campaigns reproduced an asymmetric relationship of dependency between Albania and the international institutions that monitored it by articulating corruption as internal to the Albanian condition. Finally, against corruption international and local actors could articulate a neoliberal order that was free of internal contradictions and fully compatible with democratization. As a rare example of post-structuralist discourse analysis of corruption this book can be useful for future research on discourses of corruption in other countries of the region and beyond.
