This book is a comprehensive, practice-oriented guide to the evidentiary regime under the 2015 World Anti-Doping Code (WADC) including the functioning of the Athlete Biological Passport. It is the first to show how the interplay between science and law affects the collection and evaluation of evidence in anti-doping, and how paradigm shifts in anti-doping strategies may modify evidentiary assumptions implicit to the WADC regime. Unique in its dealing with the subtleties of anti-doping science and legal implications, the book gives lawyers involved in anti-doping the keys to a better understanding of the science underlying the WADC regime, while providing anti-doping scientists with the first reference material to understand the legal framework in which their activities are embedded. The emphasis of the book is on international doping cases and it relies predominantly on CAS awards published up to Spring 2015. Written by an experienced Swiss lawyer it provides an insight into the Swiss legal system and its importance for the legal practice in doping matters. Marjolaine Viret is an attorney-at-law in Geneva, Switzerland, specialising in sports and health law. She has gained significant experience in sports arbitration as a senior associate in one of Switzerland’s leading law firms. She also holds positions within committees in sport, in particular as a member of the UCI Anti-Doping Commission. Ms Viret had her doctorate on anti-doping approved summa cum laude in 2015. She participates as a researcher in a project for a commentary of the 2015 WADC funded by the National Science Foundation and is regularly invited to lecture or speak in various fields of sports law. Le football professionnel est marqué par une période appelée le mercato durant laquelle on peut observer le phénomène d'achat et de vente de joueurs par les clubs contre le paiement de sommes d'argent. Ces indemnités de transfert permettent de rémunérer différentes parties, notamment les clubs et les agents. Au début des années 2000, des tierces parties, principalement sous la forme de sociétés d'investissement, sont apparues sur le marché des transferts. Elles ont joué le rôle de banques, en prêtant de l'argent aux clubs en échange d'un pourcentage sur la valeur économique d'un ou de plusieurs joueurs. Cette pratique, appelée " TPO ", est l'objet de la présente étude. Elle comporte une analyse juridique de la pratique sous l'angle du droit suisse et de la réglementation sportive. L'étude passe en revue la construction contractuelle de cette pratique, notamment les clauses qui composent le contrat entre la tierce partie et le club, la validité dudit contrat en droit suisse ou encore le statut du joueur vis-à-vis de ces contrats. L'étude se concentre également sur l'approche réglementaire des fédérations sportives à l'égard des TPO. Nous traitons de l'efficacité actuelle de l'interdiction des TPO et de sa légalité, mais aussi de l'opportunité d'autoriser la pratique en la réglementant. Nos développements tendent à montrer la complexité à mettre en œuvre chacune de ces solutions.

Defending ethics in sport is vital in order to combat the problems of corruption, violence, drugs, extremism and other forms of discrimination it is currently facing. Sport reflects nothing more and nothing less than the societies in which it takes place. However, if sport is to continue to bring benefits for individuals and societies, it cannot afford to neglect its ethical values or ignore these scourges. The major role of the Council of Europe and the Enlarged Partial Agreement on Sport (EPAS) in addressing the new challenges to sports ethics was confirmed by the 11th Council of Europe Conference of Ministers responsible for Sport, held in Athens on 11 and 12 December 2008. A political impetus was given on 16 June 2010 by the Committee of Ministers, with the adoption of an updated version of the Code of Sports Ethics (Recommendation CM/Rec(2010)9), emphasising the requisite co-ordination between governments and sports organisations. The EPAS prepared the ministerial conference and stepped up its work in an international conference organised with the University of Rennes, which was attended by political leaders, athletes, researchers and officials from the voluntary sector. The key experiences described in the conference and the thoughts that it prompted are described in this publication. All the writers share the concern that the end result should be practical action - particularly in terms of the setting of standards - that falls within the remit of the EPAS and promotes the Council of Europe's core values.
