Berbagai kebijakan saat pandemi Covid-19 telah diterapkan sebagai upaya mencegah dan mengendalikan penyebaran virus Covid-19 serta untuk meminimalisir jatuhnya korban jiwa. Penerapan protokol kesehatan dengan ketat termasuk pemberlakuan kebijakan Pembatasan Sosial Berskala Besar (PSBB) di banyak kota di Indonesia serta kebijakan work from home secara langsung menimbulkan perubahan dalam berbagai bidang kehidupan dalam masyarakat. Dunia bisnis dan perdagangan merupakan salah satu yang sangat terdampak dengan adanya berbagai kebijakan terkait pandemi Covid-19 ini. Berbagai bidang usaha dipaksa mengubah strategi dan model bisnisnya guna mencegah dan meminimalisir kerugian dan juga dampak lain yang mungkin timbul. Bisnis yang selama ini dijalankan secara konvensional perlahan tapi pasti diubah/ ditransformasikan dalam bentuk perdagangan berbasis elektroni/digital. Perubahan-perubahan tersebut sedikit banyak berpengaruh juga pada aspek hukum terkait dengan bentuk dan jenis transaksi yang dilakukan. Kecenderungan bertambahnya kasus hukum di masa pandemi ini - khususnya terkait dengan transaksi elektronik/digital- perlu disikapi dengan bijak. Pemahaman akan hak dan kewajiban serta upaya penyelesaian sengketa dalam berbagai transaksi konsumen -khususnya secara elektronik/digital- di masa pandemi Covid-19 merupakan suatu yang dirasa penting. Kesadaran hukum masyarakat yang baik makin diperlukan dalam menghadapi berbagai resiko bertransaksi secara elektronik/digital di era pandemi Covid-19 ini, sehingga diharapkan masyarakat dapat secara cerdas dan mandiri mengamankan serta memperjuangkan hak-haknya apabila terjadi kerugian dalam bertransaksi. Sebagai ringkasan singkat intisari dari artikel-artikel dalam buku ini, dapat diuraikan sebagai berikut. Buku ini diawali dengan dengan artikel-1 yang berjudul “Transaksi Elektronik Dalam Perspektif Hak Dan Kewajiban Hukum” ditulis oleh Ibu Dr.Bernadetta Tjandra Wulandari,SH.,MH berisi penjelasan mengenai berbagai hal terkait dengan konsumen dan pelaku usaha sebagai para pihak utama dalam suatu transaksi elektronik berikut hak dan kewajibannya termasuk di dalamnya aspek pembuktian yang memiliki karakteristik khusus di luar dari ketentuan sebagaimana diatur dalam KUHPerdata. Bahasan selanjutnya terangkai dalam artikel ke-2 yang ditulis oleh Ibu Dr. Marhaeni Ria Siombo,SH.,M.Si dengan judul “Perjanjian Baku Dalam Transaksi Elektronik Dan Problematikanya” yang mengulas posisi perjanjian baku dalam transaksi elektronik berikut hal-hal yang kerap menjadi sumber permasalahan terkait isi dari perjanjian baku tersebut dikaitkan dengan kepentingan para pihak yang mengikatkan diri. Aspek penegakan hak konsumen dalam transaksi elektronik diulas dengan sangat mendalam oleh Bapak Dr.Yusuf Shofie,SH.,MH yang menyampaikan buah-buah pemikirannya dalam artikel ke-3 yang berjudul “ Penegakan Hukum Hak Konsumen”. Dalam tulisannya beliau mencermati Inventarisasi Hukum (Positif) Pada Situasi Pandemi Covid-19 dengan menguraikan beberapa peraturan serta sekaligus membahas efektivitas pilihan penyelesaian sengketa konsusmen di masa pandemic Covid-19 ini. Penulis artikel selanjutnya Ibu Valerie Selvie,SH.,LL.M.,PhD yang menguraikan hal-hal terkait dengan aspek hukum di beberapa negara ASEAN yang dituangkan dalam artikel yang berjudul “ Perlindungan Konsumen Di ASEAN”. Dalam pembahasan lebih lanjut dijelaskan kebijakan-kebijakan berkenaan dengan aspek perlindungan konsumen di negara-negara anggota ASEAN. Hal ini tentu akan menambah pengetahuan mengingat masing-masing ketentuan hukum tersebut memiliki karakteristik serta lingkup yang berbeda. Rangkaian sumbang pemikiran dalam buku ini ditutup dengan artikel yang ditulis oleh Ibu Laksana Arum Nugraheni dengan judul “Perlindungan Hukum Terhadap Data Pribadi Konsumen Dalam Transaksi Elektronik Di Masa Pandemi Covid-19”. Perlindungan data pribadi belakangan ini menjadi satu issue hukum yang cukup menarik perhatian. Terutama terbukanya potensi penyalahgunaan data pribadi dalam transaksi elektronik menjadi dasar dimunculkannya topik dalam buku ini dan diuraikan dengan sangat komprehensif. Kesederhaan akan lebih bermakna jika bisa memberikan manfaat bagi banyak orang, dibandingkan kemegahan yang hanya berguna bagi diri sendiri. Demikian pula dengan buku ini, keseluruhan sumbangsih pemikiran dari para penulis yang disajikan dalam buku ini diharapkan dapat menjadi mutiara pengetahuan dan pelita ilmu serta dapat memberikan manfaat sebesar-besarnya bagi semua pihak yang membacanya.

Disrupsi teknologi berasal dari gabungan dua kata yakni disrupsi dan teknologi. Kata disrupsi pertama kali diperkenalkan oleh Clayton M. Christensen dan Joseph Bower dalam artikelnya yang berjudul The Disruptive Inovation. Dalam bukunya Christensen mengenalkan bahwa model disruptive inovasi yaitu sebuah inovasi yang membantu menciptakan pasar dan peluang baru, mengganggu atau merusak sistem pasar yang sudah ada dan pada akhirnya menggantikan teknologi terdahulu. Namun, Francis Fukuyama seorang penulis buku The Great Disruption tahun 1999, memiliki pendapat yang berbeda mengenai pengertian disrupsi tersebut. Ia mengartikan disrupsi sebagai sebuah guncangan yang merusak sistem tatanan sosial di masyarakat. Walaupun pendapat dari kedua pakar tersebut berbeda, jika disimpulkan tetap memiliki suatu makna yang sama.

Internet research spans many disciplines. From the computer or information s- ences, through engineering, and to social sciences, humanities and the arts, almost all of our disciplines have made contributions to internet research, whether in the effort to understand the effect of the internet on their area of study, or to investigate the social and political changes related to the internet, or to design and develop so- ware and hardware for the network. The possibility and extent of contributions of internet research vary across disciplines, as do the purposes, methods, and outcomes. Even the epistemological underpinnings differ widely. The internet, then, does not have a discipline of study for itself: It is a ?eld for research (Baym, 2005), an open environment that simultaneously supports many approaches and techniques not otherwise commensurable with each other. There are, of course, some inhibitions that limit explorations in this ?eld: research ethics, disciplinary conventions, local and national norms, customs, laws, borders, and so on. Yet these limits on the int- net as a ?eld for research have not prevented the rapid expansion and exploration of the internet.
