This collection of essays on the reform of public procurement law and policy honours the contribution of Sue Arrowsmith as the leading scholar in the field. The book is divided into 3 main parts – on the UK, the EU, and the world – and focuses on central reform themes that have characterised the evolution of public procurement law and policy in the past decades. These include sustainability, complex contracts, review and remedies, electronic procurement, and defence procurement, as well as topics such as debarment, the overall development of EU procurement reform, the very nature of procurement law, or the regulation of UK procurement law after Brexit. The book also covers the dynamic reform process of the EU Procurement Directives and case law, the UNCITRAL Model Law on Procurement, the WTO Government Procurement Agreement, and national systems including the US, China, Africa, and the UK. The chapters are written by experts in specific topics of procurement reform from Africa, Asia, the Americas, and Europe with backgrounds in academia, legal practice, and international organisations. The reader is provided with a diverse set of insights into the objectives, approaches, priorities, and future direction of public procurement reform.

Public Procurement And The Eu Competition Rules written by Albert Sánchez Graells and has been published by Bloomsbury Publishing this book supported file pdf, txt, epub, kindle and other format this book has been release on 2015-06-25 with Law categories.

Public procurement and competition law are both important fields of EU law and policy, intimately intertwined in the creation of the internal market. Hitherto their close connection has been noted, but not closely examined. This work is the most comprehensive attempt to date to explain the many ways in which these fields, often considered independent of one another, interact and overlap in the creation of the internal market. This process of convergence between competition and public procurement law is particularly apparent in the 2014 Directives on public procurement, which consolidate the principle of competition in terms very close to those advanced by the author in the first edition. This second edition builds upon this approach and continues to ask how competition law principles inform and condition public procurement rules, and whether the latter (in their revised form) are adequate to ensure that competition is not distorted. The second edition also deepens the analysis of the market behaviour of the public buyer from a competition perspective. Proceeding through a careful assessment of the general rules of competition and public procurement, the book constantly tests the efficacy of these rules against a standard of the proper functioning of undistorted competition in the market for public procurement. It also traces the increasing relevance of competition considerations in the case law of the Court of Justice of the European Union and sets out criteria and recommendations to continue influencing the development of EU Economic Law.

This book explores European security and defense R&D policy, unveiling the strategic, industrial, institutional and ideational sources of the European Commission’s military research initiative. Starting from a well-defined empirical epicentre—the rise of non-civilian R&D priorities in the European Union—this book covers interrelated themes and topics such as approaches to arms production and R&D collaboration relationships between European R&D-related institutions technology and research foundations of European security policy past and present European armament collaborations transatlantic R&D collaboration the militarization of border security. Divided into 5 sections, the enclosed chapters explore the EU technology and innovation policy in regards to security, industrial competitiveness and military capabilities. The terrorist attacks in the US on September 11, 2001 provided a window of opportunity for the introduction of security as a distinct European R&D priority. In fact, since 2002, the Preparatory Action for Security Research (PASR) has funded 45 million euros to 39 research consortia to conduct security R&D. While the idea of pooling defense research efforts and programmes in Europe is not new, the establishment of institutions like the European Defense Agency (EDA) are a major step into institutionalizing European agencies involvement in supporting defense technology research. It is against this backdrop of policy developments that this book is positioned, in addition to addressing some of the political, economic, industrial and philosophical questions that arise. Featuring contributions from a variety of academic fields and industries, this book will be of interest to scholars, researchers, students and policy makers in the fields of security policy, international relations, innovation, European studies and military studies.

This book provides an empirical understanding of how EU-level defence industrial cooperation functions in practice. Using the Liberal Intergovernmental theoretical model, the book argues that while national economic preferences are an essential factor of government interests they only explain part of the dynamic that leads to the development of defence industrial policy at EU level. Moving beyond a simple adumbration of economic preferences, it shows how the EU’s institutional framework and corpus of law are used by governments to reaffirm their position as the ultimate arbiter and promoter of national economic preferences in the defence industrial sector. To this end, the work asks why and how EU member state governments, European defence firms, and EU institutions developed EU-level defence industrial policy between 2003 and 2009. The book also analyses significant policy developments, including the establishment of a European Defence Agency and two EU Directives on equipment transfers and defence procurement. This book will be of much interest to students of EU policy, defence studies, security studies and International Relations in general.

This volume offers a concise yet thorough picture of the principles of EU external relations law. The book contains up-to-date analyses of inter alia the Common Foreign and Security Policy, the Common Security and Defence Policy and the Common Commercial Policy. Moreover, it devotes specific attention to the EU's external powers as regard the environment, fundamental rights and development cooperation. In addition, it includes a dedicated chapter exploring the relations with neighbouring countries, as well as one that elucidates the complex interplay between rules of domestic, European and international provenance. One of the work’s key assets is how reflections on the law are interwoven with, and supplemented by, insights from adjacent disciplines like international studies, political science, and public administration. The third edition, like its predecessors, continues to have an undergraduate readership in mind. The inclusion of chapter overviews, clarifying boxes, and countless topical examples should prove extra enlightening for those audiences. The book managed to attract particular praise earlier for its lucid style and great accessibility. As before, its compact dimensions, transparent design and comprehensive approach should enable users to master the central features of this gripping field of law with ease. Newly appearing in the Springer Textbooks in Law series, it remains an invaluable resource for students and lecturers alike.
