Ernst Fraenkel nacque nel 1898 da una famiglia della borghesia colta ebraico-tedesca. Inizialmente professò un marxismo eterodosso fino all'avvento del Terzo Reich, cui si oppose tanto nel suo ruolo ufficiale di avvocato lavorista, quanto e soprattutto pubblicando clandestinamente saggi e articoli che poi confluirono nel suo capolavoro "Il doppio Stato". Rifugiatosi negli Stati Uniti, scoprì gli aspetti positivi dell'«American way of life», aderendo pienamente ai princìpi della liberaldemocrazia pluralista e difendendoli fino alla morte, dopo il ritorno in patria, dagli attacchi dei contestatori sessantottini e dei loro "cattivi maestri", gli esponenti della Scuola di Francoforte. È considerato il più grande politologo tedesco del XX secolo. Dopo il crollo del Muro di Berlino e l'implosione dell'URSS la democrazia, apparentemente vincitrice del pluridecennale confronto e in espansione planetaria, ha in realtà conosciuto una profonda erosione dei propri contenuti e princìpi ispiratori; la ricostruzione critica della parabola umana e intellettuale percorsa da Fraenkel può forse rappresentare uno strumento di analisi utile a chi vuol comprendere i tempi di ferro e fuoco in cui viviamo.
