This volume of essays examines the empirical evidence on school choice in different countries across Europe, North America, sub-Saharan Africa and South Asia. Everywhere experience suggests that parents are ‘active choosers’: they make rational and considered decisions, drawing on available evidence and responding to incentives which vary from context to context. Government educators frequently downplay the importance of choice and try to constrain the options parents have. But they face increasing resistance: the evidence is that informed parents drive improvements in school quality. Where state education in some developing countries is particularly bad, private bottom-up provision is preferred even though it costs parents money which they can ill-afford. America’s commitment to public schooling once seemed unshakable. But today the movement to privatize K–12 education is stronger than ever. A veteran teacher and administrator, Samuel E. Abrams examines the rise of market forces in public education and reveals how a commercial mindset has taken over. For decades, Milton Friedman and his disciples contended that private markets could deliver better schooling than governments. In the 1990s, this belief was put to the test by Edison Schools and other for-profit educational management organizations (EMOs). Edison grew rapidly, running schools in Baltimore, Philadelphia, and many other cities across the country. Yet disappointing academic and financial outcomes soon pushed the company and its competitors to the margins. The focus of EMOs on efficiency and results nevertheless found expression in federal policy with No Child Left Behind in 2002 and Race to the Top in 2009. The new ethos also defined nonprofit charter management organizations (CMOs) like KIPP that surfaced in the wake of EMOs and flourished. But the dependence of CMOs on philanthropists, tireless teachers, and students capable of abiding by rigid expectations limits their reach. Abrams argues that while the commercial mindset sidesteps fundamental challenges, public schools should adopt lessons from the business world. Citing foreign practices, he recommends raising teacher salaries to attract and retain talent, conferring more autonomy on educators to build ownership, and employing sampling techniques rather than universal assessments to gauge student progress.

In practice, most education systems have both centralized and decentralized elements. Planners involved in a decentralizing reform must identify which components of the system are more appropriately managed at the central level and which at the local level. This book is intended to inform education policymakers, planners, and practitioners about international experience in the legal aspects of decentralizing basic education. It also provides a basic understanding of how laws and regulations can be used for education reform. For purposes of the discussion, decentralization is used to describe efforts to transfer decision making power in basic education from the administrative center of a country to authorities closer to users. The term is also used in a more technical sense to describe one of the many forms this type of reform can take, and in this sense it is contrasted with deconcentration and devolution as educational reforms. The first section examines the general legal aspects of decentralization, and the second looks more closely at decentralization laws and regulations. The third section is, in effect, a checklist of items that should be included in decentralization laws, and the fourth section provides a road map to help the planner prepare and implement the laws required for reform. Although an effort has been made to keep the discussion general enough for use in many countries, the analysis is based on the legal systems of the Western world or those that they inspired.
