Outer space affords a unique physical environment in which to conduct experiments. The most widely appreciated characteristic of the space environment is that of microgravity. Outer space also provides a sterile setting not easily or inexpensively achievable on Earth. The electromagnetic and radiation levels too differ significantly from those on Earth. These and other natural attributes of outer space make it a potentially attractive environment for the conduct of experiments, which will lead to inventions in a wide range of high technology fields. This unique environment is increasingly accessible to experimenters and inventors at costs which are commercially attractive. The Mir Space Station as well as NASA Shuttle Flights already provide opportunities for experiments to be conducted in outer space. When the Multi-National Space Station is established there will be even greater numbers of experiments and research projects conducted there. Outer space also presents a unique legal environment for these activities. Recognizing this, and the uncertainty surrounding a number of central legal issues which will result from such activity, this book sheds light on the incidental legal questions that arise. Based on the papers presented at a conference on the topic in Paris, the book examines patentability and intellectual property infringement, as well as contractual issues and related topics. Also included are papers on the liabilities that arise out of activities in outer space, the relevant jurisdictional considerations, and the growing commercialization of space activities in the United States and in Europe.

Launch activities performed by private entities deal with a complex legal environment. The Space Treaties provide a general liability framework. Launch participants are subject to regulatory or institutional control, and to domestic liability laws. Specific contractual practice has developed due to insurance limitations, the inter-participants' waivers of liability and claims. This book synthesizes information on the norms of play, to allow the grasp of their relative weight and interactions in the assessment of liability risk for launch activities. It reveals a legal framework presently lacking sufficient predictability for an efficient liability risk management: the waivers of liability suffer weaknesses as do all such clauses, and lack uniformity and reliability; and the Space Treaties contain ambiguous terms preventing predictable determination of the States responsible for authorizing and supervising launch activities and for damage compensation, and do not reflect the liability of launch operators. This book offers suggestions of new approaches for: harmonizing waivers of liability to improve their consistency, validity and flow-down; and improving the Space Treaties for their implementation to non-governmental launch activities. In the launch community, the need for lawmaking is less compelling than in fields such as aviation. Nevertheless, adjustments to the present framework are proposed through model clauses and an international instrument, for further thinking and contribution by those sharing the opinion that creative lawmaking is needed now to prepare for tomorrow's endeavors.

Le présent ouvrage est issu de la collaboration fructueuse qui s'est établie depuis de nombreuses années entre le Centre de droit des obligations de l'Université Catholique de Louvain et le centre de recherche en droit privé de l'Université Paris 1. C'est le quatrième ouvrage qui paraît dans ce contexte, après ceux consacrés aux effets des contrats à l'égard des tiers, à la protection des la partie faible dans les rapports contractuels et aux sanctions de l'inexécution des obligations contractuelles. Pour la première fois, le thème choisi relève de la responsabilité civile délictuelle et non des obligations contractuelles. De 2002 à 2004, se sont tenues trois sessions de deux jours, à Paris et à Louvain-La-Neuve, où une vingtaine d'éminents spécialistes venant des deux Universités, mais aussi d'Universités étrangères et de la Commission européenne ont approfondi le thème des responsabilités environnementales. Le présent ouvrage réunit les rapports qui ont été présentés lors de ces journées. On y aborde successivement, les faits générateurs et les sources des responsabilités environnementales, les problèmes posés par l'établissement du lien de causalité, le dommage écologique et les difficultés liées à sa réparation ainsi que l'action d'intérêt collectif. Les textes internationaux instituant des responsabilités objectives dans des secteurs déterminés ne sont pas oubliés, pas plus que les questions de droit international privé. Bien entendu, nos travaux ne pouvaient ignorer l'adoption de la directive européenne du 21 avril 2004 sur la responsabilité environnementale en ce qui concerne la prévention et la réparation des dommages environnementaux. Cette directive a servi de toile de fond à tous les débats. En outre, le lecteur trouvera dans cet ouvrage un premier commentaire approfondi du texte européen par des auteurs particulièrement autorisés. Le rapport de synthèse final souligne les lignes de force qui se sont dégagées de cet examen. On y décèle les limites inhérentes à tout système de responsabilité civile. Cette étude entend ainsi contribuer à la transposition de la directive dans les différents Etats membres.
