Les prestations et droits individuels auxquels peuvent prétendre les personnes handicapées concernent plus d'un million d'adultes et 600 000 jeunes, correspondant à un montant global de l'ordre de 13 milliards d'euros répartis entre les différentes mesures. L'essentiel de ces droits individuels résulte d'une décision prise par une des "commissions des droits et de l'autonomie des personnes handicapées (CDAPH)" attachées aux "maisons départementales des personnes handicapées (MDPH)". Au total, les CDAPH prennent entre 2 et 2,5 millions de décisions par an : cartes d'invalidité, formation, emploi, ESAT, allocations enfants ou adultes, subventions... Ces chiffres sont éloquents : les décisions des CDAPH concernent directement des millions de citoyens, leurs familles, leurs conseils et les associations qui les accompagnent. Pourtant, les procédures et modalités d'obtention de ces droits restent complexes et souvent mal connues des professionnels et des personnes handicapées. Quel rôle joue la commission dans l'attribution des mesures et/ou des prestations ? Comment prend-elle ses décisions ? Quel rôle est reconnu à la personne handicapée tout au long du processus décisionnaire ? Quels sont les recours possibles ? Devant quelle instance ou juridiction ? Cet ouvrage, unique, répond à toutes ces interrogations. Il propose une description complète et pédagogique des mesures, illustrée de nombreux exemples et décisions inédites des juridictions de l'incapacité : l'ensemble des prestations et droits individuels auxquels peuvent prétendre les personnes handicapées et les modalités procédurales nécessaires à leur obtention est ainsi analysé. Fort de son expérience de près de trente ans dans le secteur du handicap, l'auteur accompagne le lecteur dans les méandres juridiques qui conditionnent les décisions des CDAPH. The various contributions are accompanied by strong recommendations that challenge the holders of issues for their application in a process of co-construction for an active citizenship of transformation. It is a document of advocacy/indictment and lobbying in favor of the development, protection and improvement of the social conditions of the elderly and persons with disabilities in Africa in terms of health, food, housing, environment, social protection, income maintenance, employment and education, given their increasing numbers in relative and absolute terms. The issue of socially vulnerable people is thus brought to the forefront of important, if not permanent, political-social and scientific concerns. It is the subject of recurrent investigations and reflections within the special mechanism of the African Union, the Working Group on Elderly Persons and Persons with Disabilities of the African Commission on Human and Peoples' Rights. The initial assignment is to build legal, psychological, socio-anthropological and political vehicles in order to initiate positive change and sustainable protection of VHPs, as well as customary protocols for their valorization in African cultures and traditions.
