The motor vehicle technology covered in this book has become in the more than 125 years of its history in many aspects an extremely complex and, in many areas of engineering science . Die Untersuchung erarbeitet praxisnah die rechtlichen Auswirkungen von Fahrerassistenzsystemen. Zu Beginn werden Fahrerassistenzsysteme, deren Wirkungsweise und Spezifikationen näher dargestellt, die verbaut werden oder marktreif und für die Arbeit relevant sind. Sodann werden die einschlägigen Haftungsnormen auf Besonderheiten im Hinblick auf Fahrerassistenzsysteme untersucht. Im Anschluss werden die Pflichten der Kfz-Halters und des Kfz-Führers analysiert. Detailliert erörtert werden etwa, ob eine Informations- und Instruktionspflicht des Kfz-Halters besteht, der einem personenverschiedenen Fahrer sein Kfz zur Verfügung stellt. Ebenso, ob eine bedingungslose Instandhaltungspflicht für sämtliche Fahrerassistenzsysteme besteht. Weitere Pflichten für Kfz-Halter und Kfz-Führer sind Gegenstand der Untersuchung.Im versicherungsrechtlichen Teil der Arbeit wird dargelegt, dass für Fahrerassistenzsysteme ein weitreichender Versicherungsschutz besteht, andererseits Fahrerassistenzsysteme den Versicherungsschutz auch gefährden können. Gegenstand der Untersuchung sind die Kfz-Haftpflicht- sowie die Kfz-Kaskoversicherung.Zum Schluss rückt die Produkthaftung in den Fokus. Die bisherigen Herstellerpflichten werden erörtert, wobei nach Auffassung des Verfassers u. U. eine außergesetzliche Implementierungspflicht von Fahrerassistenzsystemen sowie Vorkehrungen zur Vermeidung von Fehlgebrauch erforderlich sind. Weiterhin Schwerpunkt dieses Abschnitts sind die ordnungsgemäße Instruktion sowie die Rückrufpflicht des Herstellers. Der Autor vertritt die Auffassung, dass die bisherige Instruktionsweise nicht ausreichend ist und unterbreitet einen Lösungsvorschlag.Das Buch richtet sich an Assekuranzen, Kfz-Hersteller und sonstige Personen, die sich näher mit den rechtlichen Auswirkungen technischer Innovationen der Kfz-Branche sowohl in Wissenschaft und Praxis beschäftigen.
