Il digitale ha cambiato le nostre vite di tutti i giorni. Lo sta facendo da anni e più passa il tempo più lo fa in maniera inesorabile e profonda: è un mutamento radicale di prospettiva che ci obbliga a diventare consapevoli delle differenze, delle opportunità e anche dei rischi che offre rispetto ai corrispondenti analogici ai quali sta via via subentrando. Per questo la scuola non può più ignorarlo e farne a meno. Per lo più, però, tende a piegarlo alle sue forme, ai suoi ritmi, alle sue routine, depotenziandolo e facendo in modo da evitare di confrontarsi con le novità e i cambiamenti che esso esige. Ci si trova allora di fronte a una sorta di ibrido mitologico come l’ircocervo: solo che, in questo caso, anziché avere un animale per metà capro e per metà cervo abbiamo tecnologie, processi e sevizi digitali usati come se fossero analogici, all’interno di stili di pensiero e di strutture organizzative ancora tradizionali. Così quello che dovrebbe essere un ponte per traghettare la scuola verso un futuro che è già qui e ora, guarda al passato: e come ci racconta Kafka, un ponte non può voltarsi indietro senza abdicare alla propria funzione e precipitare.

However you view the present time, it is a new century, a new world, and also a new humanity - in fact, humanity is not something that was ever defined once and for all, but remains an open project. For several decades we have been witnessing a revolution. However, unlike the political and ideological revolutions that took place around the First World War, this is a technological and much more radical one that does not depend on people's beliefs, but rather on the tireless labour of machines. The rise of automation has brought about a revelation of something that had hitherto remained hidden in the workshops of homo faber. That is, there are very few functions, apart from consumption, where a machine cannot replace a human being, be these material or spiritual - machines need energy, but they can also do without it, whereas humans die if deprived of it, or one can imagine a machine producing symphonies, but not enjoying them. So while human beings are still needed, their roles and scopes have to be reconsidered. Workers may be superfluous, but humans are still needed, including those who until recently only recognised themselves as producers. The exclusion of workers from production does not discount humans being able to produce value in the form of consumption. Recognising this will enable us to conceive the "Webfare" - a new digital system that will teach us to find new names and new forms, more tolerance and room for traditional human needs. Above all, it will teach us how to transform the time given to us by automation into an opportunity for progress.

The book starts with an analysis of what is new in the Digital Services Act. The aim is to see whether this new Regulation is appropriate both for not halting technological innovation and for addressing the risks that technological innovation poses to society and to the people who use digital services. The focal point is the risk of discrimination as people are often helpless in the face of the potential discriminations in the digital services sector. In particular, the book analyses how the Digital Services Act can make a concrete contribution to the protection against discrimination. To this end, it focuses on the responsibility of digital service providers and the fact that discrimination may also depend on the way in which algorithms and artificial intelligence systems are used. Therefore, a comparison is made between the Digital Services Act and the proposed Artificial Intelligence Act. The comparison discloses that the risk-based approach is the common thread followed by the EU in regulating the digital market. The book elaborates also on the practical implications of the risk-based approach. Highlighting advantages and limitations leading the author to conclude that the risk-based approach is the way forward only if the differences between risk and danger, the limits of law, and the limits of the tendency to humanise artificial intelligence systems are considered. With specific reference to the risk of discrimination, the need for a systemic and multi-level approach is highlighted, which reinforces the contribution that can be made not only by the Digital Services Act, but also by more general and cross-cutting legislation as those on data protection and unfair commercial practices.
