Excerpt from Handbook of the Law of Evidence At the request of the publishers, the author has endeavored to find time for a re-examination of the subject of Evidence, and a revision of his treatment of it as found in the first edition of this work prepared in 1897. The principles do not change materially in a decade, but added experience and a different point of view may in some instances result in a more satisfactory statement of them. The changes in this second edition are not many, although there have been re-arrangement and additions in most of the chapters and some, notably the chapter on Judicial Notice, which has been re-written, and the chapters on Burden of Proof, Presumptions, Admissions and Writings, which have been enlarged, present the respective subjects of which they treat in somewhat different form from the corresponding chapters of the first edition. The aim has been to avoid a compilation of cases, and while many thousands, decided since 1897, have been examined, comparatively few have been added as citations. The purpose of the work is now, as it was in the former edition, to give a statement of principles with illustrations of their application, and some discussion of the manner of their development; the work will, therefore, serve better one who seeks light upon the law of Evidence viewed as a science than one who seeks a precedent for some particular case. The author, therefore, again disclaims any attempt to present the law of all the States or of any one of them, and has cited cases from the different jurisdictions indiscriminately, locking only to their value as illustrations of the application of those principles which seem to him to be at the foundation of an intelligent understanding of the law of Evidence. Excerpt from Leading Cases and Statutes on the Law of Evidence This book was originally intended for the use of students only. I now find, however, that it has been extensively used by practitioners, especially at Quarter Sessions, as presenting, in a handy form, the substance of cases constantly referred to. In order to make it more worthy of the attention thus bestowed on it, I have now considerably supplemented it. The chief additional feature of this edition is the collection of Statutes on Evidence, forming Part II. of the book. I have taken much trouble to select all the important statutory provisions relating to evidence, including those contained in statutes dealing with other matters but having special provisions as to evidence. I believe this collection to be the fullest in existence on the subject. I have not attempted to make it absolutely complete, as it would be useless, and wasteful of space, to insert some of the provisions on special matters. But I believe that every statutory provision on the subject, likely to be required, will be found in the collection, except those relating to procedure, with which I do not profess to deal. Some of the provisions given are of small importance in themselves, but they serve to illustrate points or rules stated in other portions of the book. Another new feature is the Index, which did not appear in the first edition, the rather elaborate Table of Contents being thought sufficient It is hoped that this will add to the usefulness of the book. The Table of Contents has also been much enlarged, and is intended to afford a complete and systematic outline of the whole subject. A few additional cases have been given, the notes have been considerably amplified, and the whole subject to some extent re-arranged. The arrangement has been a matter of much difficulty. No two books on Evidence agree, even approximately, in arrangement. That adopted in the present book is the outcome of a careful consideration of all the chief works on the subject. I am much indebted to others for suggestions, especially to the learned writer of a review in the Law Quarterly Review of April, 1908, whose views on the Law of Evidence must always be entitled to the highest respect. I feel the weight of his criticisms generally, and believe that the following pages show that I have profited by them. If, says Mr. Taylor, the rules of exclusion, recognized till lately by the English law, had been really founded, as they purported to be, on public experience, they would have furnished a omost revolting pic ture of the ignorance and depravity of human nature. In rejecting the evidence of parties to the record, and other interested witnesses, the law acted on the presumption, not only that such persons, sooner than make a statement which might prejudice themselves, would commit deliberate perjury, but that, if they did so, juries would be incapable of detect ing the falsehood.
