Intellectual Property law is a dynamic field; its ever-changing landscape challenges us to constantly revisit the existing laws and policies. Although ideological currents of a second-tier patent (STP) regime are sweeping through the South Asian region in recent years, the concept of utility model or petty patent remains a largely unexplored option in Sri Lanka and in other parts of the South Asian region. Against this backdrop, this book offers an alternative approach to incentivise minor and incremental innovations of SMEs. It also explores whether Sri Lanka and other developing economies in the South Asian region can benefit from such an STP regime if it is tailored to the specific characteristics of the innovation landscape of the country. Nishantha Sampath Punchi Hewage, LL. B. (Hons.), LLM in IP (MIPLC), is a Lecturer in the Faculty of Law, University of Colombo, Sri Lanka. This book analyses the relationships among product safety strategy and culture, concurrent engineering, new product development (NPD) processes and product safety performance. Product safety is a matter of enormous economic and societal concern, given the safety risks to consumers and the financial risks to producers. Nevertheless, a thorough conceptual understanding of the effects of NPD policies and practices is still largely missing, as several large-scale trends have made clarifying the role of product safety in its socio-economic context difficult, including: the rise of consumerism and the shift in the balance of power from manufacturers to customers and regulators; the internationalization of value chains and the fragmentation of markets worldwide; and technological change leading to a sophistication of products that rendered average consumers increasingly unaware of risk and potential accidents. This volume sets out to close the gaps among research, practice and policy, with an emphasis on advocating responsible product innovation. Through an in-depth study of the durable juvenile products industry, the authors discover important relationships, for example that top management involvement, safety-first culture and robust NPD processes are paramount in increasing product safety and decreasing product recalls in firms. On the other end of the spectrum, concurrent engineering does not automatically lead to product safety, they found no “magic bullet” through which product safety can be tied to the use of a particular tool, skill, or practice. Offering a dynamic framework for aligning the interests of multiple stakeholders, including manufacturers, regulators, and consumers, the authors provide a clearer understanding of product safety and its implications for scholars, students, policy makers, and practitioners in the areas of innovation management, product management, R&D management, and responsible research and innovation.

A framework for assessing the security risks of emerging dual-use technologies and devising tailored governance strategies is proposed and applied to contemporary case studies. Recent advances in disciplines such as biotechnology, nanotechnology, and neuropharmacology entail a “dual-use dilemma” because they promise benefits for human health and welfare yet pose the risk of misuse for hostile purposes. The emerging field of synthetic genomics, for example, can produce custom DNA molecules for life-saving drugs but also makes possible the creation of deadly viral agents for biological warfare or terrorism. The challenge for policymakers is to prevent the misuse of these new technologies without forgoing their benefits. Innovation, Dual Use, and Security offers a systematic approach for managing the dual-use dilemma. The book presents a “decision framework” for assessing the security risks of emerging technologies and fashioning governance strategies to manage those risks. This framework is applied to fourteen contemporary case studies, including synthetic genomics, DNA shuffling and directed evolution, combinatorial chemistry, protein engineering, immunological modulation, and aerosol vaccines. The book also draws useful lessons from two historical cases: the development of the V-series nerve agents in Britain and the use and misuse of LSD by the U.S. Army and the CIA. Innovation, Dual Use, and Security offers a comprehensive, multifaceted introduction to the challenges of governing dual-use technologies in an era of rapid innovation.
