This book finds its origins in a transatlantic colloquium held in the European Parliament in Brussels in May 2002. After an introductory overview of the US and European responses to 9/11 it addresses the main legal aspects of the fight against international terrorism, namely police and judicial cooperation (including mutual legal assistance, extradition and the role of entities like Europol and Eurojust), financial initiatives (e.g. by the UN Security Council, the FATF and the EU), human rights and rule of law issues (such as trial by military commissions, detention of alleged unlawful combatants and others, state of emergency derogations, due process, the death penalty and privacy) and international law aspects (inter alia self-defence, the application of international humanitarian law, prisoner of war status, the role of the UN, in particular the Security Council, sanctions and the negotiations on a comprehensive convention on combating terrorism). Each topic is considered from a US and from a European perspective.

President George W. Bush maintained in his address of 20 September 2001, that the successful prosecution of the war against terrorism will require the judicious use of 'every resource at our command - every means of diplomacy, every tool of intelligence, every instrument of law enforcement, every financial influence, and every necessary weapon of war'. Unlike the Cold War, the War on Terrorism is neither a battle against some ideology nor bounded by physical boundaries or conventional political units such as nation-states. The War on Terrorism is the internationalisation, or rather, globalisation of previous wars. Terror is not a nation, and the enemies in such wars are not nations; any regime such as Libya simply by repudiating terrorism, can become an ally of the anti-terror coalition. Regimes that continue to practice terrorism against domestic opponents qualify to participate in the wider war if they conform to certain norms in external affairs. The 28 articles reprinted here consider aspects of that most amorphous of animals - the War on Terrorism. They do not set out to provide all of the answers; nor do they radiate a unified vision of what constitutes the war on terrorism; the pieces begin from a range of political and intellectual outlooks. Taken as a group, however, the difficulties of determining the limits and nature of the war on terrorism receive important attention. An international manual is like a world cruise: a once-in-a-lifetime experience. All the more reason to consider carefully whether it is necessary. This can hardly be the case if previous research in the selected field has already been the subject of an earlier review-or even several competing surveys. On the other hand, more thorough study is necessary if the intensity and scope of research are increasing without comprehensive assessments. That was the situation in Western societies when work began on this project in the summer of 1998. It was then, too, that the challenges emerged: any manual, espe cially an international one, is a very special type of text, which is anything but routine. It calls for a special effort: the "state of the art" has to be documented for selected subject areas, and its presentation made as compelling as possible. The editors were delighted, therefore, by the cooperation and commitment shown by the eighty-one contributors from ten countries who were recruited to write on the sixty-two different topics, by the con structive way in which any requests for changes were dealt with, and by the patient re sponse to our many queries. This volume is the result of a long process. It began with the first drafts outlining the structure of the work, which were submitted to various distinguished colleagues. De la mise en place - par la SNCF - d'un nouveau système de distribution, dénommé Socrate, au début de l'année 1993, on a surtout retenu les difficultés et la grogne des usagers qui s'ensuivit. Mais l'innovation technologique n'était que l'un des aspects d'une mutation organisationnelle plus profonde. Socrate a, en effet, constitué un véritable projet d'entreprise pour l'un des nouveaux centres de responsabilités de l'établissement national, l'Activité Grandes Lignes. La conduite du projet - impulsé au départ par quelques membres de la direction de l'entreprise - a été effectuée en associant étroitement les personnels à sa réalisation, permettant ainsi une réforme profonde des modes de fonctionnement habituels de la SNCF. Pourquoi, alors, les déboires que l'on connaît ? La généralisation du système informatique a fait ressortir les pratiques que le projet n'avait, précisément, pas réussi à modifier : alors que Socrate était adopté par l'ensemble de l'Activité Grandes Lignes, l'absence des usagers dans sa préparation, doublée de la médiocrité de la communication externe, ne pouvait qu'amener - de leur part - une attitude de rejet, qui compromettait ainsi les efforts de changement de la SNCF.
