Le rôle économique de l'Etat est contesté. Depuis l'avènement du capitalisme, il en a toujours été ainsi. Les économistes libéraux,, classiques ou néo-classiques n'ont souvent accordé à l'Etat qu'un rôle de gendarme, réduit au pouvoir de faire respecter les lois fondées sur la propriété privée, l'initiative individuelle, la cohérence et la sécurité nationales. La naissance de l'URSS apportera une contestation brutale à cet univers idéal et idéel de l'optimalité des forces du marché. Avec la crise de 1929 et l'apport théorique de Keynes, l'Etat a été sollicité dans l'ordre économique, favorisant ainsi l'essor des politiques économiques conjoncturelles et structurelles. Cependant, la récession économique qui a suivi les " Trente Glorieuses ", aux résultats économiques inégalés, a favorisé l'essor du néo-libéralisme et une nouvelle contestation de l'action économique de l'Etat. L'efficacité économique de ce dernier, son rôle de redistribution ou la pertinence de son intervention ont été remis en cause. On a alors parlé de " moins d'Etat " pour " mieux d'Etat " dans le meilleur des cas, ou d'un Etat improductif et prédateur dans le pire des cas. A chaque crise, le rôle de l'Etat est redéfini, en faveur soit d'une réduction, soit d'un renforcement de son action économique. Il n'est pas indépendant du développement particulier de la société dans laquelle il vit. De ce fait, son action change dans le temps et dans l'espace. Nécessaire pour maintenir la cohésion sociale par la production de biens collectifs, l'Etat favorise aussi les effets pervers de la technocratie et de la bureaucratie et la " privatisation " de l'intérêt collectif. Il est aussi illusoire d'attendre de lui les solutions aux problèmes économiques quotidiens que de le vouer à l'inactivité. La question n'est donc pas de savoir si l'Etat doit ou non intervenir dans l'ordre économique, mais plutôt de définir son rôle en fonction de la réalité des dysfonctionnements du marché et de l'action publique.

This is a three-part study of the relations between law and liberty. Volume 1 deals with the basic conceptions necessary for a critical analysis of prevailing theories of justice and of the conditions which a constitution securing personal liberty would have to satisfy. In volume 2, the author examines the theories of utilitariansim and legal positivism and considers the concept of 'social justice.' He shows this ideal to be devoid of meaning and therefore a most harmful and dangerous cause of the mis-direction of well-meant efforts: he demonstrates that it is a remnant of the tribal ethics of a closed society and whooly incompatible with the individual freedom whih the Open Society promises. In the final volume, Hayek analyses and discards modern sociobiological theories of morality and social conduct, demonstrating that man's behaviour pattern has been determined more by custom than by the exercise of reason, and that mind and culture therefore developed concurrently and not successively. He shows how the democratic ideal is in danger of miscarrying due to the erroneous assumptions that there can be moral standards without moral discipline, that the element of tradition can be ignored in proposals for restructuring society, and the way in which the disctinct ideals of egalitarianism and democracy are increasingly confused.
