Despite the obvious advantages accruing from its central location and the presence of the EU institutions in its capital city Brussels, Belgium has never fully fulfilled its potential to emerge as an attractive jurisdiction for international arbitration. Now, however, with the adoption in 2013 of an entirely new arbitration law, and the accompanying overhaul of the rules of CEPANI, the Belgian Centre for Arbitration and Mediation, Brussels is poised to progress rapidly towards the top rank of European and global seats of arbitration. This is the first comprehensive treatise in English to provide practical guidance to arbitration practitioners, in-house counsel, and judges on how to conduct arbitrations in Belgium. To facilitate its use, it is structured as an article-by-article commentary on the 2013 Law addressing the following aspects of each article: • the purpose of the provision; • comparison with the UNCITRAL Model Law on Commercial Arbitration; • party autonomy; • issues of costs; and • interplay with the rules of other major arbitration institutions and the New York Convention. La loi belge sur l’arbitrage a été fondamentalement revue et amendée par la loi du 24 juin 2013. Cette loi prend appui sur un texte bien connu des praticiens de l’arbitrage, la loi type du 25 juin 1985 amendée le 7 juillet 2006 relative à l’arbitrage commercial international de la Commission des Nations Unies pour le droit commercial international (CNUDCI). Elle est aussi basée sur une analyse de droit comparé quant à la manière dont cette loi type a, en tout ou en partie, été reprise par un certain nombre de législations nationales comme la loi allemande et sur une étude des droits qui ne prennent pas en compte la loi type comme les lois française et néerlandaise. Elle tient aussi compte de l’ancienne loi belge dans ses dispositions qui ont été reçues positivement par la pratique et dont l’application n’a pas suscité de difficultés particulières. La nouvelle législation a rendu nécessaire cette 3ème édition. Le présent volume axé sur le droit belge prend appui sur l’édition précédente de 2006 qu’il revoit, développe et complète à l’aune de la nouvelle loi. Il n’est pas inutile de rappeler ici que cette nouvelle loi ne trouve à s’appliquer qu’aux procédures d’arbitrage engagées après le 1er septembre 2013 de sorte que l’édition de 2006 de l’ouvrage conserve toute sa valeur et sa pertinence pour les arbitrages en cours au 1er septembre 2013. L’esprit qui a présidé à l’ouvrage de 1981 et à celui de 2006 est conservé : commenter les différents aspects de l’arbitrage, développer à leur propos une réflexion critique, relever les implications pratiques des différents thèmes abordés.

De même que les règles et usages déontologiques ont une vie autonome, aux côtés du droit civil et du droit pénal, comme du droit administratif, mais en lien avec eux, ainsi les procédures disciplinaires suivent-elles un cours autonome, à l’écart des procédures civiles, pénales ou administratives, mais en s’inspirant d’elles. Le droit disciplinaire est abordé sous divers angles dans le présent volume. Au plan international d’abord, diverses conventions, dont essentiellement la Convention européenne des droits de l’homme, ont légitimé les juridictions disciplinaires, mais en les soumettant aux règles du procès équitable avec quelques aménagements. L’état actuel de la jurisprudence de la Cour de Strasbourg est donc fondamental. Au plan européen ensuite, l’importante fonction publique européenne est soumise à un statut spécifique, dont les aspects disciplinaires seront examinés. Quant à la fonction publique belge, elle obéit à des règles générales s’appliquant au service public. Elle sera traitée sous deux aspects : la fonction publique en général et les règles spécifiques de la magistrature. Comme il était impossible, dans le cadre d’une formation, de prendre en compte l’ensemble des professions réglementées, les professions juridiques suivantes sont abordées : le barreau, le notariat, les juristes d’entreprise et les huissiers de justice.
