Il volume raccoglie gli atti del Convegno internazionale su "International Religious Freedom and the Global Clash of Values", co-organizzato dal Dipartimento di Giurisprudenza della LUMSA di Roma e dai Center for Law and Religion e Center for International and Comparative Law dell'Universita' di St. John's, di New York, e svoltosi a Roma il 20 e 21 giugno 2014. Vi si sono discussi, da parte di accademici, di esperti e di personalita' politiche, di diverso orientamento e cultura, aspetti giuridici e politici della liberta' religiosa: la dimensione concettuale, la natura di diritto fondamentale inerente alla dignita' dell'essere umano, il rapporto con le norme sui diritti umani, l'effettivita', per citarne alcuni. In un momento storico nel quale la liberta' religiosa e' gravemente minacciata da quello che appare un conflitto globale dei valori, e nel quale guerre, atti di terrorismo e persecuzioni, che sono la negazione stessa della dignita' umana, vengono compiuti in nome della religione, il convegno si prefiggeva di compiere un passo in avanti nella definizione "approfondita e grandemente precisa", per stare all'auspicio espresso da Papa Francesco, dei presupposti giuridici e politici della liberta' religiosa, necessari per assicurarne l'effettivo ed universale riconoscimento quale diritto fondamentale della persona umana, base essenziale di una convivenza giusta e pacifica, a livello nazionale e internazionale, che persegua il bene comune dell'umanita'.

Pubblicato nel 1973, il libro si è imposto all’attenzione della comunità scientifica, segnando un punto fermo nel dibattito sulla libertà religiosa. Dedicato ai rapporti tra ateismo e libertà religiosa nell’ordinamento giuridico italiano, il libro ne segue l’evoluzione storico-giuridica spingendo l’indagine oltre la rilevazione delle garanzie normative della libertà, per cercare di «individuare, al di là del significato letterale, il valore reale, l’incidenza sociale di norme e concetti giuridici che, pur non esprimendosi mai apertamente in questa direzione, favoriscono poi incisivamente la diffusione della religione (e di una determinata religione) ostacolando quella dell’ateismo». Proponendo e sperimentando questo percorso, il libro è riuscito a scuotere il dibattito scientifico su ateismo e religione in corso negli anni Settanta, indicando un metodo d’indagine ancora oggi utile a guidare e stimolare la ricerca di una protezione giuridica equilibrata della libertà di credere e di non credere.
