Este livro aborda, por meio de investigação teórica e empírica, premissas, interfaces jurídico-comunicacionais de reportagens jornalísticas rememorativas em cotejo com um possível direito ao esquecimento, tema que abre possibilidade para aproximação, articulações e tensionamento entre a Comunicação e o Direito, pelo viés do jornalismo, pois envolve consequências jurídicas de práticas jornalísticas e consequências jornalísticas de práticas jurídicas. Trata-se de temática dotada de notória relevância nos cenários social, comunicacional e jurídico, sobretudo em vista das consequências da divulgação de matérias jornalísticas que destacam atos criminosos preteritamente praticados por personagens centrais de reportagens rememorizantes contemporaneamente publicadas. No aspecto social, emerge a reflexão em razão de a temática contemplar situações que se repetem com frequência na prática do jornalismo. Na esfera comunicacional, a pertinência temática aflora diante da necessária percepção crítica de práticas jornalísticas rememorativas, com abordagens que perpassam temas comunicacionais que dizem respeito ao acontecimento, acontecimento jornalístico, produção, circulação, memória estigma e liberdade de imprensa. Igualmente, no cenário jurídico contemporâneo a abordagem é proeminente em razão das discussões, divergências e indefinições que permeiam a temática, o que tem provocado reflexões quanto à aplicação ou não do direito ao esquecimento e as circunstâncias em que juridicamente restaria configurado. O direito ao esquecimento, como consectário do direito à intimidade, à vida privada, vem recebendo tratamento lapidar pelo Poder Judiciário brasileiro, no sentido de sopesar casuisticamente a situação das partes envolvidas, a fim de decidir o conflito de forma a salvaguardar o princípio da dignidade da pessoa humana. Este livro apresenta abordagem propositiva sobre o direito ao esquecimento diante de reportagens rememorativas, apontando critérios para aferição e recomendações para compatibilização das práticas jornalísticas a um possível direito ao esquecimento.
