Las universidades públicas han desarrollado actividades con entidades sin ánimo de lucro que han favorecido la expasión de la educación en diferentes partes de Colombia, esta investigación pretende indagar sobre el punto de convergencia entre la responsabilidad contractual que se genera en un acontrato de servicio administrativo, la responsabilidad extracontractual que se forma por la calidad del servicio de educación prestado de la supervisión al momento de designar su razón misional como Estado a particulares. El presente libro describe la participación de las universidades públicas en el proceso de supervisión en los contratos de servicio con las entidades sin ánimo de lucro que realizan funciones operativas o misionales de las entidades de gobierno; para luego describir la responsabilidad extracontractual del Estado por la falta de supervisión en contratos con las entidades sin ánimo de lucro, definiendo el concepto de responsabilidad, el proceso de reconocimineto de este (daño, imputación y nexo causal) y la importancia de la supervisión en un proceso contractual que puede convertirse en el foco de la responsabilidad imputable al Estado. Finalmente, describe el caso específico de la responsabilidad extracontractual que pueda existir imputable a la Universidad del Valle por la omisión de la supervisión en los contratos con fundaciones adscritas a ella, se realiza una explicación de la realción Universidad del Valle-fundaciones, el diagnóstico contractual del mismo y se describen en dos(2) casos puntuales de aparente responsabilidad con daño imputable.
