In seeking to take counsel with you here to-night on the grave problem our habitual criminals present, I have been most desirous not merely to iterate deplorings I have perhaps too often vainly made elsewhere, nor to suggest remedial action, which, plausible in itself, overlooks or underrates the difficulties which may render it impracticable. Those who even rightly contemplate existing evils from their own point are at times too prone to dictate changes, the carrying out of which lies outside their own sphere and responsibility, and then to brand as official obstruction the hesitation of the responsible departments to accept their methods. I have then essayed to approach this subject with some competent knowledge of our present penal system as it exists beyond the domain of the courts of justice. This study has been facilitated by the Blue Books of the Royal Commission on Penal Servitude, issued by Sir R. Cross, and presided over by the Earl of Kimberley in 1878-'79, in which by the most skilled witnesses, chief members of the English and Irish Prison Boards, governors and officials of all the chief prisons, and including even some half dozen ticket-of-leave men, the whole system is graphically portrayed.

Excerpt from The Habitual Criminals Bill, and Reformatories for Adults In the same clause occurs the same measure as in the previous, viz., that the offender after such third conviction if found under circumstances of suspicion, may be sentenced to 12 months' imprisonment by two Justices or a Stipendiary Magistrate. As I have before said, I do not like throwing the responsibility of a. 12 months' sentence upon a Court of hardly sufficient weight to bear it. And here I think another alteration is needful. On the cumulative principle, successive punishments ought to increase in severity, and when a man has had seven years penal servitude, it seems useless to return him to the common Gaol. I should like therefore to add that he may be committed on summary conviction before two Justices to imprisonment not exceeding three months; or before Quarter Sessions or Assizes, to penal servitude not exceeding seven years. Before leaving this Clause you must pardon my again saying that I believe it will turn out to be the most important measure for the Repression of Habitual crime that has ever been passed. Excerpt from Juvenile Offenders I have had occasion to point out publicly from time to time that one of the formidable problems confronting civilised communities at the close of the present century is the problem of habitual crime. It is perfectly well known to every serious student of criminal questions, both at home and abroad, that the proportion of habitual criminals in the criminal population is steadily on the increase and was never so high as it is now. In almost every official document dealing with penal administration this unsatisfactory state of things is both admitted and deplored. In France, Germany, and Italy the proportion of old offenders who come before the criminal courts is constantly growing, while in Eng land matters are just as bad. This is made perfectly clear by the report of the Committee on the Iden tification of Habitual Criminals. From a table compiled for the use of that committee it appeared that in Lancashire, the West Riding of Yorkshire, and Staffordshire about 70 per cent. Of the prisoners tried were known to have been previously convicted in Liverpool, Birmingham, and Bradford, 79 per cent. Excerpt from Criminal Sociology The following pages are a translation of that portion of Professor Ferri's volume on Criminal Sociology which is immediately concerned with the practical problems of criminality. The Report of the Government committee appointed to inquire into the treatment of habitual drunkards, the Report of the committee of inquiry into the best means of identifying habitual criminals, the revision of the English criminal returns, the Reports of Committees appointed to inquiry into the administration of prisons and the best methods of dealing with habitual offenders, vagrants, beggars, inebriate and juvenile delinquents, are all evidence of the fact that the formidable problem of crime is again pressing its way to the front and demanding re-examination at the hands of the present generation. The real dimensions of the question, as Professor Ferri points out, are partially hidden by the superficial interpretations which are so often placed upon the returns relating to crime. At their core, these stories are about race, nationality, gender, and religion, and how they affect our lives and our feelings about ourselves and our relationships with others. In some cases we wear disguises. In others we flaunt our backgrounds or make up new ones to enhance our circumstances. Who we are and who we aren't are the determinants of our fate.
