Esistono problemi globali che non fanno parte dell’agenda politica dei governi nazionali, anche se dalla loro soluzione dipende la sopravvivenza dell’umanità. Il riscaldamento climatico, il pericolo di conflitti nucleari, le disuguaglianze, la morte di milioni di persone ogni anno per mancanza di alimentazione di base e di farmaci salvavita e le centinaia di migliaia di migranti in fuga segnano il nostro orizzonte presente e futuro. In gran parte dipendono dall’assenza di limiti ai poteri selvaggi degli Stati sovrani e dei mercati globali. Tuttavia, secondo Luigi Ferrajoli, un’alternativa istituzionale e politica è possibile e la sua stella polare è una Costituzione della Terra. Non si tratta di un’ipotesi utopistica. Al contrario, è la sola risposta razionale e realistica allo stesso dilemma che Thomas Hobbes affrontò quattro secoli fa: la generale insicurezza determinata dalla libertà selvaggia dei più forti, oppure il patto di convivenza pacifica basato sul divieto della guerra e sulla garanzia dell’abitabilità del pianeta e perciò della vita di tutti. La vera utopia, l’ipotesi più inverosimile, è l’idea che la realtà possa rimanere così come è: l’illusione cioè che potremo continuare a fondare le nostre democrazie e i nostri tenori di vita sulla fame e la miseria del resto del mondo, sulla forza delle armi e sullo sviluppo ecologicamente insostenibile delle nostre economie. Solo una Costituzione della Terra, che introduca un demanio planetario a tutela dei beni vitali della natura, bandisca le armi a cominciare da quelle nucleari e introduca un fisco e idonee istituzioni globali di garanzia in difesa dei diritti di libertà e in attuazione dei diritti sociali di tutti può realizzare l’universalismo dei diritti umani, assicurare la pace e, prima ancora, la vivibilità del pianeta e la sopravvivenza dell’umanità.

Perché ci sono emergenze e catastrofi globali, come la pandemia tuttora in atto, che non fanno parte dell’agenda politica dei governi nazionali, anche se dalla loro soluzione dipende la sopravvivenza dell’umanità: il riscaldamento climatico e gli inquinamenti globali dei mari e dell’aria, di cui soffrono soprattutto le popolazioni dei paesi poveri benché siano prodotti dallo sviluppo insostenibile dei paesi ricchi; le guerre e i pericoli di catastrofi e conflitti nucleari determinati dalle migliaia di testate atomiche tuttora presenti sul pianeta; la crescita delle disuguaglianze e della povertà e la morte ogni anno di milioni di persone per mancanza di alimentazione di base e di farmaci salva-vita; la produzione e la diffusione di armi che ogni anno provocano guerre e centinaia di migliaia di omicidi; il dramma, infine, di masse crescenti di migranti che fuggono da queste tragedie per poi incontrare, quando non perdono la vita nelle loro terribili odissee, l’oppressione razzista dovuta alle loro personali identità differenti. Soltanto la stipulazione di un nuovo patto globale di pacifica convivenza, di mutuo soccorso e di rispetto e tutela della natura è in grado, realisticamente, di garantire l’abitabilità della Terra e il futuro all’umanità.

Le ragioni della Costituzione della Terra stanno nella necessità di affrontare risolvere le sfide globali in atto che espongono l’umanità ai gravi rischi dovuti al poteri selvaggi del mercato globale, causa di catastrofi e pandemie planetarie (“crimini di sistema”: riscaldamento climatico e ambiente degradato, guerre, produzione di armi e riarmo atomico, fame, malattie e diritto alla salute, migrazioni di massa, crimine organizzato e terrorismo internazionale): problemi irrisolti, rispetto alle quali le istituzioni internazionali vigenti (a cominciare dall’ONU, esposta al declino) risultano assolutamente limitate e insufficienti essendo espressione della crisi della democrazia sul piano mondiale. La risposta possibile, come alternativa realistica e adeguata, sta nella capacità di andare oltre ed espandere universalmente i poteri degli Stati nazionali a favore di poteri sovrastatali e globali, sia pubblici che privati, creando una Costituzione mondiale, come legge fondamentale della Federazione della Terra e unità di misura di un mondo globalizzato.

Modern state law excludes populations, peoples, and social groups by making them invisible, irrelevant, or dangerous. In this book, Boaventura de Sousa Santos offers a radical critique of the law and develops an innovative paradigm of socio-legal studies which is based on the historical experience of the Global South. He traces the history of modern law as an abyssal law, or a kind of law that is theoretically invisible yet implements profound exclusions in practice. This abyssal line has been the key procedure used by modern modes of domination – capitalism, colonialism, and patriarchy – to divide people into two groups, the metropolitan and the colonial, or the fully human and the sub-human. Crucially, de Sousa Santos rejects the decadent pessimism that claims that we are living through 'the end of history'.
