Het thema van de bescherming van persoonsgegevens is actueler dan ooit. Een paradoxale eigenschap van persoonsgegevens is dat zowel het geheim houden, als het uitwisselen ervan gedaan kan worden onder het argument van `veiligheid'. Het geheim houden van persoonsgegevens verhoogt veiligheid doordat deze gegevens niet misbruikt kunnen worden. Het uitwisselen van persoonsgegevens verhoogt veiligheid omdat het opsporingsdiensten helpt criminelen en terroristen te vangen. Zowel de argumenten voor het geheim houden van gegevens, als die voor het uitwisselen van gegevens zijn valide. Het probleem is helder: het uitwisselen van gegevens en het geheim houden van gegevens lijkt niet, of althans moeilijk, samen te kunnen gaan. Dit is niet alleen een probleem in de discussie tussen de voorvechters van privacy en de voorstanders van verregaande opsporingsbevoegdheden. Ook opsporingsdiensten zelf worstelen met het spanningsveld van uitwisseling versus geheimhouding: het is makkelijker een subject (bijvoorbeeld een verdachte) in de gaten te houden als hij of zij daar niet op beducht is. Wanneer het subject weet dat hij onderwerp van onderzoek is, kan hij of zij bijvoorbeeld mogelijk bezwarende bewijzen vernietigen. Hoe meer mensen binnen een opsporingsorganisatie weet hebben van een lopend onderzoek, hoe groter de kans is dat er gelekt wordt naar het subject. Aan de andere kant, hoe meer mensen binnen opsporingsdienst weet hebben van een lopend onderzoek, hoe meer mensen kunnen meehelpen met dat onderzoek. Het hoofddoel van dit proefschift is om te onderzoeken of het mogelijk is om oplossingen voor dit spanningsveld te vinden. De resultaten van het onderzoek zijn van fundamentele en praktische waarde. Aan de fundamentele kant laten we zien, dat een een aantal problemen überhaupt oplosbaar is. Legal Theory, Sources of Law and the Semantic Web is an attempt to construct an integrated conceptual framework for the application-neutral and problem-neutral representation of sources of law using Semantic Web technology and concepts, and some technically straightforward extensions to Semantic Web technology based on established practices found in fielded applications. To construct this framework, the author disentangled some problems that are often mixed up in legal theory and – in extension – legal knowledge representation. The purpose of this framework is to provide a theoretical background for the creation of reusable and maintainable knowledge components representing knowledge of sources of law on the Semantic Web. These components should form a basis for the development for computer applications supporting straightforward, routine decision making problems using traditional methods. This book aims to be a work of ontology: an account of relevant aspects of the knowledge domain of law from the perspective of a legal knowledge engineer interested in sources of law. One cannot however say that the result of this work is an ontology: this book presents a mix of design principles, design patterns for knowledge representation in OWL DL and ontology fragments.

The study outlines the status quo of international cooperation in competition law matters. This is done by examining, in chronological order, the various approaches of the many multi- and bi-lateral international agreements that have attempted to solve the problems of competition law (WTO, GATT, etc.). Subsequently, the focus of this thesis is on the analysis of bilateral trade agreements. Within the framework of this analysis, the potential of trade agreements for competition law cooperation is to be shown. For this reason, only those bilateral trade agreements are analyzed that deal with the topic of regulatory cooperation in competition law in specially provided competition chapters. In doing so, the different stages of cooperation will be analyzed along the different integration phases of any trade agreements. The highest form of trade agreement integration – customs unions – will be dealt with separately, using the EU as an example.
