This book brings together Indigenous, Third World and Settler perspectives on the theory and practice of decolonizing law. Colonialism, imperialism, and settler colonialism continue to affect the lives of racialized communities and Indigenous Peoples around the world. Law, in its many iterations, has played an active role in the dispossession and disenfranchisement of colonized peoples. Law and its various institutions are the means by which colonial, imperial, and settler colonial programs and policies continue to be reinforced and sustained. There are, however, recent and historical examples in which law has played a significant role in dismantling colonial and imperial structures set up during the process of colonization. This book combines usually distinct Indigenous, Third World and Settler perspectives in order to take up the effort of decolonizing law: both in practice and in the concern to distance and to liberate the foundational theories of legal knowledge and academic engagement from the manifestations of colonialism, imperialism and settler colonialism. O recurso cada vez maior ao Tribunal Europeu dos Direitos do Homem pelos cidadãos dos Estados Partes na Convenção Europeia dos Direitos do Homem justifica o tratamento nesta edição do Protocolo 11, adoptado em 11 de Maio de 1994, que substituiu pelo Título II (artigos 19.o a 51.o) os Título II a IV dessa Convenção. Esse Protocolo cria aquele Tribunal, extingue a Comissão e oferece protecção jurisdicional a esses cidadãos, a organizações não governamentais e a grupo de particulares, permitindo-lhes, de forma inequívoca, o acesso directo a esse Tribunal. Essa alteração, apesar de ser ensinada e discutida nas aulas, ainda não estava reflectida nesta obra, pelo que, pela sua inequívoca importância, entendemos que deveria, sem mais demoras, nela ser integrado. É o que agora se faz nesta edição.

This volume examines the role of League of Nations committees, particularly the Advisory Committee of Jurists (ACJ) in shaping the statute of the Permanent Court of International Justice (PCIJ). The authors explore the contributions of individual jurists and unofficial members in shaping the League’s international legal machinery. It is a companion book to The League of Nations and the Development of International Law: A New Intellectual History of the Advisory Committee of Jurists (Routledge, 2021). One of the guiding principles of the book is that the development of international law was a project of politics where the idea and notion of an international society must contend with the political visions of each state represented on the different legal committees in the League of Nations during the drafting of the Covenant. The book constitutes a major contribution to the literature in that it shows the inner workings of some of the legal committees of the League and how the political role of unofficial members was influential for the development of international law in the early twentieth century and how they influenced the political and legal process of the ACJ.
