English summary: The introduction of technological innovations always causes unforeseeable risks and damages. Since the rules of the law always refer to known problems, legal innovations are necessary in order to regulate new types of damages. These innovations are brought about by legal decisions and legislation, and can be regarded as the result of cumulative variation-selection processes. In this work, Martina Eckardt analyzes the central economic, legal and political selection mechanisms. She uses the German law pertaining to accidental damage to demonstrate the effectivity of the theory of legal development she is describing. She focuses her empirical analysis on the development of the modern liability law and the legal regulation of industrial accidents in the 19th century. German description: Technische Innovationen bergen und erzeugen stets nicht vorhersehbare Risiken und Schaden. Da sich das Recht immer nur auf bereits bekannte Probleme bezieht, sind zur Regulierung solch neuartiger Schaden Rechtsinnovationen notwendig. Rechtliche Neuerungen werden durch die Rechtsprechung und Gesetzgebung hervorgebracht. Sie lassen sich als kumulativer Variations-Selektionsprozess darstellen. Dieser Prozess wird durch negative Verteilungseffekte der mit technischen Innovationen verbundenen neuartigen Schadigungen vorangetrieben. Da das Schadensvolumen der neuen Technik systematisch uber ihren Marktzyklus variiert, lassen sich Hypothesen uber das Auftreten von Rechtsinnovationen in Abhangigkeit vom Marktzyklus formulieren. Allerdings sind wegen der Nicht-Vorhersagbarkeit des Inhaltes der Rechtsinnovationen nur Aussagen uber ihre Bandbreite moglich. In diesem Zusammenhang analysiert Martina Eckardt die zentralen okonomischen, rechtlichen und politischen Selektionsbedingungen. Die Fruchtbarkeit einer solchen Theorie der Rechtsentwicklung stellt sie am Beispiel der Entwicklung des deutschen Unfallschadensrechts dar, fur das das Eisenbahnwesen eine wesentliche Rolle spielte. Im Mittelpunkt ihrer empirischen Analyse steht das moderne Haftpflichtrecht und die rechtliche Regelung von Arbeitsunfallen durch das Unfallversicherungsgesetz im 19. Jahrhundert. Diese rechtlichen Paradigmen wirken in ihren Grundzugen bis in die Gegenwart, indem sie die rechtliche Regulierung technischer Innovationen wie etwa der Gen- und Biotechnologie beeinflussen.
