Souvent défini comme procédant de la norme fondamentale appelée Constitution mais aussi, plus classiquement, comme « l’ensemble des institutions grâce auxquelles s’établit, s’exerce et se transmet le pouvoir politique dans l’État » (Marcel Prélot), le droit constitutionnel régit les autorités politiques suprêmes et règle les relations établies entre gouvernants et gouvernés. Circonscrit à l’étude de la théorie générale du droit constitutionnel dont les concepts et principes fondamentaux ont été forgés dans le monde occidental, cet ouvrage, à partir de l’expérience française, traite dans une première partie du cadre général de l’organisation du pouvoir politique : l’État constitutionnel. Dans une seconde partie, il envisage les voies et moyens qui, en son sein, du seul point de vue institutionnel, sont de nos jours considérés comme la condition nécessaire – bien que non suffisante – d’un gouvernement légitime combinant limitation du pouvoir des gouvernants et participation au pouvoir des gouvernés. Sans prétendre à l’exhaustivité mais sans exclure non plus la discussion de certaines idées reçues ou dans l’air du temps : celles, notamment, qui, accouchées par la modernité tardive, sont devenues le catéchisme des postmodernes. Ce manuel est destiné aux étudiants en première année de licence en droit ou d’AES et aux élèves des Instituts d’études politiques ainsi qu’aux candidats aux concours de la fonction publique.
