Studienarbeit aus dem Jahr 2006 im Fachbereich Politik - Allgemeines und Theorien zur Internationalen Politik, Note: 1,7, Martin-Luther-Universität Halle-Wittenberg, Sprache: Deutsch, Abstract: Eine Arbeitsgruppe der Stiftung „Initiative & Referendum Institute Europe“ (IRI Europe) unter der Leitung von Andreas Gross und Bruno Kaufmann, deren Anliegen die Optimierung direktdemokratischer Beteiligungsformen ist, hat die Volksgesetzgebung in den europäischen Staaten untersucht und vor vier Jahren erstmalig den „IRI Europe Länderindex zur Volksgesetzgebung 2002“ veröffentlicht. In diesem Länderindex sind die direktdemokratischen Verfahren von 31 europäischen Staaten bewertet und in ein entsprechendes Ranking gebracht worden. Der bis dato einmalige Länderindex ist das Ergebnis einer umfangreichen Recherche, der im Wesentlichen drei Leitfragen zu Grunde liegen: 1. Existieren direktdemokratische Elemente und Verfahren auf Staatsebene? 2. Wenn ja, können Bürgerinnern und Bürger diese selbst auslösen (z. B. Volksinitiativen)? 3. Sind obligatorische Referenden verankert? In lediglich zwei Nicht-EU-Mitgliedsstaaten (Liechtenstein, Schweiz) konnten die Leitfragen mit Ja beantwortet werden, „es folgen drei Länder (Italien, Slowenien, Lettland) in denen die Bürger unabhängig von Parlament und Regierung gesamtstaatliche Volksabstimmungen auslösen können, sowie vier Staaten mit obligatorischen Referenden (Irland, Dänemark, Litauen, Slowakei). Dazu kommen die Niederlande, wo seit Anfang 2002 ein (schwaches und noch ungeprüftes) Referendumsrecht besteht. In allen anderen geprüften Ländern verfügen Parlament und/oder Regierung/Präsident über die Kompetenz, Volksabstimmungen zu verhindern.“ Hieraus ergeben sich sechs Länderkörbe, in denen IRI Europe die untersuchten Staaten (entsprechend der Güte ihrer direktdemokratischen Elemente) einteilt: Korb 1 – Die Avantgardisten Liechtenstein*, Schweiz* Korb 2 – Die Demokraten Italien, Slowenien, Lettland, Irland, Dänemark, Litauen, Slowakei, Niederlande Korb 3 – Die Vorsichtigen Frankreich, Spanien, Österreich, Schweden, Norwegen*, Polen, Ungarn Korb 4 – Die Ängstlichen Großbritannien, Finnland, Estland, Belgien, Island*, Luxemburg, Deutschland, Griechenland, Tschechien Korb 5 – Die Hoffnungslosen Rumänien*, Portugal, Bulgarien*, Malta Korb 6 – Die Schlusslichter Zypern, Türkei* Der Autor konzentriert sich in seiner Arbeit ausschließlich auf die Staaten der Europäischen Union. Da sich kein EU-Mitglied unter den Avantgardisten wieder findet, wird dieser Korb nur der Form halber erwähnt, bleibt aber inhaltlich weites gehend unberücksichtigt.

This book demonstrates that the generally assumed dichotomy between referendums and representative democracy does not do justice to the great diversity of referendum types and of how referendums are used in European democracies. Although in all referendums citizens vote directly on issues rather than letting their political representatives do this for them, some referendums are more direct than others. Rather than reflecting the direct power of the People, most referendums in EU countries are held by, and serve the interests of, the political elites, most notably the executive. The book shows that these interests rarely match the justifications given in the public debate. Instead of being driven by the need to compensate for the deficiency of political parties, decision-makers use referendums primarily to protect the position of their party. In unravelling the strategic role played by national referendums in decision-making, this book makes an unconventional contribution to the debate on the impact of referendums on democracy.
