La preuve pénale doit aujourd'hui relever deux défis majeurs : celui de l'internationalisation, avec le développement du droit pénal communautaire et des juridictions internationales; celui des nouvelles technologies, se traduisant par l'apparition de nouvelles infractions mais aussi de nouveaux modes de preuve. L'étude - menée par le Centre de droit international (CEDIN) de l'université Paris X-Nanterre - fait apparaître un grand nombre d'innovations, mais aussi beaucoup de chantiers d'avenirs et quelques incertitudes. Ainsi, le droit communautaire pénal semble dans une phase de croissance encore limitée par la réticence des Etats à entrer dans une logique d'intégration dans ce domaine si sensible qu'est le droit pénal. La coopération avec les juridictions pénales internationales n'en est qu'à ses prémisses, même si elle est appelée à se développer de manière inévitable - et spécialement pour la France - en raison de la création d'une juridiction internationale permanente, la Cour pénale internationale. Quant aux nouvelles technologies, elles sont sources d'incontestables progrès dans la lutte contre le crime, mais créent également un sentiment d'insécurité dans la sécurité : qu'il s'agisse de la vidéosurveillance ou de l'empreinte génétique, le défi semble bien, pour l'avenir, de faire en sorte que ces nouveaux modes de preuves n'aboutissent pas à l'avènement d'une société Big Brother ou Gattaca. Les défis sont donc nombreux et exigent une attention et une réflexion continues de la part des autorités sur ces questions. La " Mission de recherche Droit et Justice " a été créée en 1994 sous la forme juridique d'un groupement d'intérêt public par le ministère de la Justice et le CNRS. Elle est chargée de définir et de mettre en œuvre une politique scientifique de recherche pluridisciplinaire sur l'ensemble des questions qui concernent le droit et la justice (site internet : www.gip-recherche-justice.fr).

This book discusses issues relating to the application of AI and computational modelling in criminal proceedings from a European perspective. Part one provides a definition of the topics. Rather than focusing on policing or prevention of crime – largely tackled by recent literature – it explores ways in which AI can affect the investigation and adjudication of crime. There are two main areas of application: the first is evidence gathering, which is addressed in Part two. This section examines how traditional evidentiary law is affected by both new ways of investigation – based on automated processes (often using machine learning) – and new kinds of evidence, automatically generated by AI instruments. Drawing on the comprehensive case law of the European Court of Human Rights, it also presents reflections on the reliability and, ultimately, the admissibility of such evidence. Part three investigates the second application area: judicial decision-making, providing an unbiased review of the meaning, benefits, and possible long-term effects of ‘predictive justice’ in the criminal field. It highlights the prediction of both violent behaviour, or recidivism, and future court decisions, based on precedents. Touching on the foundations of common law and civil law traditions, the book offers insights into the usefulness of ‘prediction’ in criminal proceedings.
