La premessa fondamentale dei saggi in questo volume è che la mediazione linguistica e l’interpretariato in ambito giuridico sono rilevanti per la tutela dei diritti umani primari e che tutti gli individui hanno diritto a un processo equo. Molti capitoli di questo libro hanno messo in rilievo come la traduzione e l’interpretariato siano mezzi utili a scavalcare le barriere tra persone che non parlano la stessa lingua; salvaguardano i diritti dell’individuo, sia esso imputato, testimone o vittima e garantiscono la sicurezza dell’intera comunità. Ogni autore presenta un diverso background formativo e di esperienze: dal mondo accademico a quello istituzionale, dagli interpreti in tribunale a quelli del linguaggio dei segni per la Comunità Sorda. Si tratta insomma di contesti formativi diversi per dare voce a diversi settori dell’ambiente giuridico, quello delle forze di polizia, dei tribunali, degli istituti penitenziari e dei centri di identificazione ed espulsione. Mondi complessi in cui si proiettano due professioni complesse: la mediazione linguisticoculturale e l’interpretariato legale. Analizzando le vulnerabilità del sistema attuale e le debolezze settoriali di oggi, soprattutto a livello normativo, guardiamo in avanti per migliorare alcuni aspetti di domani, in cui ci si augura che la recente Direttiva europea possa essere applicata integralmente: dal reclutamento regolamentato dei mediatori linguistico-culturali alla identificazione di ruoli e competenze precise, dall’istituzione di un registro professionale alla qualità del processo traduttivo. Tutto in virtù di un miglioramento della comunicazione grazie a un ruolo, quello del mediatore-interprete, fondamentale ma spesso sottovalutato, nel contatto fra il mondo dei migranti e quello della società di accoglienza.

This volume discusses EU criminal justice from three perspectives. The first concerns fundamental rights following the adoption of the directives that have progressively reinforced the cornerstone of procedural rights of suspects and defendants in national criminal proceedings in the EU member states so as to facilitate judicial cooperation. Using interaction as a fundamental springboard, Addressing Methodological Challenges in Interpreting Studies Research showcases the major breakthrough in interpreting studies made by investigating community interpreting and the inherent high degree of participant interaction. The book adds a ‘reflexive’ twist, and espouses the notion of the analyst as not separate from the context under study. After looking at dialogue interpreters, cast away from the carpeted walls of sound-proof booths and deprived of the spotlighted lectern-podium position at high level fora, it has become clear that the interpreter’s invisibility, not to mention their neutrality, is uppermost in the minds of both users and providers in terms of expectations. Different forms of ‘interaction’ between researchers and the data in their studies are inevitable. As the 21st century gets into stride so does the call for a discipline combining culture and translation. This second edition of Translating Cultures retains its original aim of putting some rigour and coherence into these fashionable words and lays the foundation for such a discipline. This edition has not only been thoroughly revised, but it has also been expanded. In particular, a new chapter has been added which focuses specifically on training translators for translational and intercultural competencies. The core of the book provides a model for teaching culture to translators, interpreters and other mediators. It introduces the reader to current understanding about culture and aims to raise awareness of the fundamental role of culture in constructing, perceiving and translating reality. Culture is perceived throughout as a system for orienting experience, and a basic presupposition is that the organization of experience is not 'reality', but rather a simplified model and a 'distortion' which varies from culture to culture. Each culture acts as a frame within which external signs or 'reality' are interpreted. The approach is interdisciplinary, taking ideas from contemporary translation theory, anthropology, Bateson's logical typing and metamessage theories, Bandler and Grinder's NLP meta-model theory, and Hallidayan functional grammar. Authentic texts and translations are offered to illustrate the various strategies that a cultural mediator can adopt in order to make the different cultural frames he or she is mediating between more explicit.
