The contributions brought together in this book derive from joint seminars, held by scholars between colleagues from the University of Oxford and the University of Paris II. Their starting point is the original divergence between the two jurisdictions, with the initial rejection of the public-private divide in English Law, but on the other hand its total acceptance as natural in French Law. Then, they go on to demonstrate that the two systems have converged, the British one towards a certain degree of acceptance of the division, the French one towards a growing questioning of it. However this is not the only part of the story, since both visions are now commonly coloured and affected by European Law and by globalisation, which introduces new tensions into our legal understanding of what is "public" and what is "private".

En 2019 paraissait un ouvrage de droit positif consacré à la distinction entre droit public et droit privé, issu d’une collaboration entre les centres de droit privé (Cepri) et de droit public (Circ) de la Faculté de droit de Saint-Louis. Le Séminaire interdisciplinaire d’études juridiques a choisi de poursuivre et d’approfondir la réflexion, sur le terrain de la théorie du droit, mais également d’ouvrir le champ de recherche aux enjeux interdisciplinaires de la distinction public/privé. Le cycle s’est terminé en septembre 2021, par un colloque consacré aux brouillages, innovations et influences croisées de la « distinction (droit) public/(droit) privé ». Le présent ouvrage reprend non seulement les contributions écrites de ce colloque, mais également celles de plusieurs séances du séminaire consacré à ce thème. Afin de repenser cette division à la fois nécessaire et impossible, très ancienne et pourtant toujours recomposée sous des formes nouvelles, il s’imposait de croiser les regards de juristes, de criminologues, d’anthropologues du droit et de philosophes. Le résultat est foisonnant et ouvre des perspectives originales. Sont ainsi convoqués tour à tour Arendt et le droit européen, Kant et le droit pénal, les indicateurs de prospérité et le droit du travail, les finances publiques et l’intime, les big data et le droit des marchés publics, les communs et le droit subjectif. Au-delà de la binarité rassurante de ces deux pôles structurants de la pensée occidentale, les différents angles d’analyse convergent sur un point : si le sujet n’est pas neuf, il n’a rien perdu de son actualité. Le présent volume a l’ambition d’avoir contribué à en dévoiler quelque peu la complexité.

Cette étude a pour objet d'analyser les implications des mutations de la distinction du droit public et du droit privé pour le droit international privé, et plus particulièrement pour le conflit de lois. En effet, dans la mesure où l'on enseigne traditionnellement que la méthode du conflit de lois prend pour point de départ la summa divisio, ses transformations influencent nécessairement le conflit de lois. Plus précisément, cette recherche est fondée sur le constat de la résistance de la distinction du droit public et du droit privé, en dépit des remises en cause récurrentes dont elle fait l'objet. Quand bien même son tracé et son rôle évoluent sans cesse, elle ne nous semble pas avoir perdu sa raison d'être, tant que subsiste la res publica. Il nous a dès lors paru pertinent de transposer à la summa divisio la formule de Maurice Hauriou relative à l'existence de la juridiction administrative : "c'est peine perdue de la discuter ; au contraire, il faut en accepter la donnée et en observer le jeu". L'observation du jeu de la distinction du droit public et du droit privé nous a conduit à analyser ses mutations à partir de trois paradigmes - libéral, post-étatique et constitutionnel -, chacun éclairant sous un jour particulier l'opposition du droit public et du droit privé. Il a alors fallu étudier au sein de chacun de ces trois paradigmes l'influence de ces évolutions sur le conflit de lois.

The development of an autonomous English public law has been accompanied by persistent problems - a lack of systematic principles, dissatisfaction with judicial procedures, and uncertainty about the judicial role. It has provoked an ongoing debate on the very desirability of the distinctionbetween public and private law. In this debate, a historical and comparative perspective has been lacking. A Continental Distinction in the Common Law introduces such a perspective. It compares the recent emergence of a significant English distinction with the entrenchment of the traditional Frenchdistinction. It explains how persistent problems of English public law are related to fundamental differences between the English and French legal and political traditions, differences in their conception of the state administration, their approach to law, their separation of powers, and theirjudicial procedures in public-law cases. The author argues that a satisfactory distinction between public and private law depends on a particular legal and political context, a context which was evident in late nineteenth-century France and is absent in twentieth-century England. He concludes byidentifying the far-reaching theoretical, institutional, and procedural changes required to accommodate English public law.

"Introduction to Public Law" is a historical and comparative introduction to public law.
