L'émergence de la théorie de l'abus en matière contractuelle traduit l'évolution incessante du droit des obligations et des contrats. L'étude montre que l'abus dans l'exécution du contrat est une faute de comportement, un manquement à une règle de conduite, abstraction faite de l'exercice du droit. Ce constat mène à déterminer la responsabilité qui en découle : celle-ci se déduit de la nature de la faute commise et se spécifie conformément au principe du non-cumul de la responsabilité contractuelle et de la responsabilité délictuelle.

Avec l'harmonisation du droit des assurances des Etats africains francophones materialisee par l'adoption du Code CIMA, le legislateur communautaire ne manque pas d'encadrer la relation contractuelle dans le sens de la necessaire bonne foi devant presider a l'execution du contrat d'assurance. Cela se traduit a l'egard des parties par l'exigence d'un devoir de loyaute dans la mise en uvre de leurs prerogatives respectives, tant du point de vue de l'assure que du point de vue de l'assureur. Toutefois, en depit des sanctions edictees a l'encontre des parties, la loyaute se trouve a maints egards eludee, lorsque le legislateur CIMA manque de nombreuses occasions de reprimer la deloyaute de l'assure. Plus encore, il n'existe pas, en l'etat actuel, une obligation de nature a contraindre l'assure a minimiser son dommage. Une telle obligation peut toutefois etre inferee des dispositions du Code CIMA."
