La Guida LE NUOVE REGOLE ANTIRICICLAGGIO si pone al servizio di tutti i soggetti obbligati (intermediari bancari e finanziari, altri operatori finanziari, professionisti, operatori non finanziari e prestatori di servizi di gioco) chiamati ad affrontare rilevanti cambiamenti che comportano la rivisitazione ed il perfezionamento dei propri assetti organizzativi nonché della loro policy in materia, unitamente alla necessità di provvedere alla formazione permanente del personale coinvolto. Nell’ultimo biennio, il sistema di prevenzione e contrasto del riciclaggio di denaro e del finanziamento del terrorismo ha visto l’emanazione di numerose norme attuative, soprattutto a cura delle Autorità di vigilanza di settore (Banca d’Italia, IVASS e CONSOB), in tema di adeguata verifica della clientela, organizzazione, procedure e controlli interni e degli Organismi di autoregolamentazione (CNN, CNDCEC, CNF) che hanno approvato le Regole Tecniche destinate ai professionisti. Con il recente D.Lgs. 4 ottobre 2019, n. 125 è stata recepita la Direttiva (UE) 2018/843 (V Direttiva), introducendo importanti novità, tra le quali: - ampliamento dei soggetti obbligati; - regolamentazione più stringente delle valute virtuali; - restrizioni alle carte prepagate; - approccio comune ai Paesi terzi ad alto rischio; - accesso allargato alle informazioni sulla titolarità effettiva; - puntuali politiche e procedure di gruppo; - modifiche in tema di adeguata verifica rafforzata e sanzioni; - cooperazione internazionale e tra FIU. Vanno poi ricordate le istruzioni della Banca d’Italia sulle PEPs, per gli uffici della Pubblica amministrazione, sulle comunicazioni oggettive, per gli operatori che svolgono professionalmente l’attività di custodia e trasporto denaro e in materia di valute virtuali, non tralasciando le linea guida nel comparto del gaming emanate dall’ADM come pure il decreto ministeriale sul funzionamento del registro degli operatori compro oro. Il testo contiene, inoltre, le misure introdotte dal D.L. 26 ottobre 2019, n. 124 (Decreto fiscale 2020) sul limite dell’uso del contante, sui pagamenti elettronici, sugli incentivi per il cashless e nel settore dei giochi.

Contains thirteen national reports and the general report on Money Laundering and Banking Secrecy. The reports were written for the XIVth Congress of the International Academy of Comparative Law which was held in 1994 in Athens, Greece. As narcotics trafficking exploded in the 1980s, it was realized that money laundering had become a threat to the entire integrity of the financial system. The international trend to regard money laundering as a serious threat to the stability of democracy and the rule of law found expression in the adoption of the 1988 United Nations Drugs Convention. Gradually, the international community diverged from its traditional, narrow approach whereby only the laundering of drug proceeds was considered a threat. In order to combat money laundering efficiently, it soon became clear that criminal law was not sufficient and that it was necessary for banks and other financial institutions to co-operate with law enforcement agencies. The banking community is now obliged to report suspicious transactions, which they often regard as going beyond their role as bankers. The issue of bank secrecy has played an important role in the discussion between law enforcement agencies and the banking community. Both the Council of Europe Convention on Laundering Search, Seizure and Confiscation of the Proceeds from Crime and the UN Drugs Convention require that bank secrecy should not be an obstacle to international co-operation. At the national level the seizure of bank records should not be hindered by bank secrecy.
